Spencer wrote about this last night. The Supreme Court is set to strike down Roe v. Wade. A draft majority opinion was leaked to the press. Someone decided to shop the draft of the ruling for the Dobbs v. Jackson Women's Health Organization case, which sent earthquakes through DC. So much for liberals being the defenders of institutions. So much for "the norms," right?

We have "woke" staffers leaking opinions to the press, shattering the trust among the justices and their staffers, and presenting the greatest security breach in the history of the Court. This was done to target the conservative wing. This was done to shake up the 2022 midterms cycle in favor of the Democrats. Yet, it might have been too early. It's only May. We have a long way to go before November.

The Supreme Court authenticated the draft and ordered the Marshal of the Supreme Court to launch an investigation. The FBI will be involved as well most likely, but one Democratic senator doesn't want that to happen.

Mr. Dark Money hypocrite Sheldon Whitehouse doesn't want the bureau to investigate the leak. He mentioned this during a Senate Judiciary hearing on judicial ethics today, which only makes the remarks richer. Nothing says judicial ethics than leaking a draft opinion. This is the most unforgivable sin, as SCOTUSblog noted. ...

Whitehouse doesn't want a leak investigation because this really wasn't a leak. It wasn't done out of some patriotic duty. This isn't a whistleblower situation. It's a political operation. It's this Democratic Party still infuriated that Donald Trump picked three justices and got them all confirmed. It's about their affinity for infanticide. It's about trying to do anything to distract the American people from the disastrous leadership under Joe Biden....

I don’t know about this leak being an unforgivable sin but to me it’s another indication that our country has lost all legitimacy and no institution is immune to the rot of communism, progressivism or whatever you want to call it.

Maybe I’m missing something here. Who cares about a “leak” of a draft document? I’m all for transparency in government proceedings. Let’s stop this sanctimonious silliness about treating our courts like they’re some kind of religious institutions. Screw them. Take a look at the transcripts of the oral arguments in any given Supreme Court case, and you’ll find that many of these justices are no more intelligent or capable than your average member of a high school debate team.

For every Supreme Court case there only needs to be a formal announcement of the final decision on each point of law in dispute, and a listing of how the justices voted on each one.

Let each judge write a treatise to document his or her own opinion … or don’t write anything at all. WGAF about most of the nonsense that shows up in these opinions and dissents. Invariably, the written records of these cases are prepared by law clerks anyway. One big reason for this is that many of the justices are incapable of thinking clearly enough to write them themselves.

I would add this observation...even if you find the person, what law will be used on them? I think the most you can do....fire them for poor ethical practices. On the positive side, twenty years from now....their name won’t come up for some federal judge appointment.

Lord, they think THEY are all powerful, so I pray for YOU to demonstrate that your will be done….Smackdown the evil which reigns in our congressional halls and shake up those who smugly feel they are so beyond the laws of this land….

How about theft of government documents. The draft is government property and thus taking it from its proper place and giving it to someone not authorized to have it is a crime of theft. Unfortunately under the Pentagon papers decision the folks at Politico can not be prosecuted for possessing/publishing it unless they committed a crime in the process of obtaining it, (but that may not be true based on the Project Veritas/Biden diary incident).

The FBI - the cleanup crew - give me a break! Not a chance the FBI will find the crook with this corrupt administration running the show. They (the entire administration) want to destroy the Court along with the Country

I was going to start down this same line, to stir discussion and thought anyway.

Why not have all the deliberations done in public? We’d see the social values subjected to modification, what side effects were considered, the perceived scope of federal and judicial jurisdiction, and so on.

I’m not seriously advocating this, but it does put “the leak” into persepctive. I LOL at all the sanctimony. “Sacred trust” is long gone between the government and the people, so having an institution rattled by its own palace intrigue is “just deserts.”

Make of his disjointed logic what you will. He made them during a hearing on "Transparency and Accountability for 21st Century Courts." That hearing is ostensibly for legislative purpose, discussing what laws might be made.

The moral arrogance that allowed the court to pull a right thing kill babies out of its collective ass is the same self righteousness that precipitated this leak. The Chief Justice of the court in his autobiography admitted that they simply thought it was time.

He does raise an interesting point. Was it a Federal crime for someone to “leak” a draft of a court document? I suspect not — only because most of the commentary I’ve seen on the story seems to focus on what transpired as a “breach of ethics,” not a crime.

If this is the case, then there’s no reason for the FBI to even answer the phone when the dopey Chief Justice calls them for help in investigating the “leak.”
