A Kansas middle school teacher who was disciplined for refusing to use a student’s preferred first name and gender pronouns is suing the school district.
Fort Riley Middle School math teacher Pamela Ricard said in a federal lawsuit filed Monday that the Geary County School District violated her constitutional rights and did not accommodate her Christian beliefs when it suspended her for three days.
The district did not immediately return messages left Wednesday seeking comment on the lawsuit. The school is located in Fort Riley, a U.S. Army base that’s 130 miles (210 kilometers) west of Kansas City.
Ricard, who has taught at the school since 2005, was reprimanded and suspended in April 2021 for addressing a student as “miss” to avoid using the student’s preferred first name after Picard was told that the student used he/him pronouns.
Ricard believed addressing the student as “Miss (legal/enrolled last name)” respected the student while also upholding Ricard’s religious convictions, according to the lawsuit.
A school counselor had told Ricard the student preferred a first name different from his legal and enrolled name. The student had never told Ricard of the preference, but a classmate told Ricard the student preferred he/him pronouns, according to the lawsuit, filed by Kriegshauser Ney Law Group.
The suit says Ricard believes that God assigns gender at birth and any policy requiring her to use language that is different from the student’s biological sex “actively violates Ms. Ricard’s religious beliefs.”

I told her I refuse and would only address her by her last name. Her mother flipped out when she heard it. I just said, I refuse to be bullied into using something that might change tomorrow.

It would probably be more successful if she made it a 1st amendment freedom of speech claim. The school is publicly funded, so it cannot put prior restraint on speech, and demanding that teachers refer to people by certain “pronouns” is a clear prior restraint on speech.
Administration to teacher: “We like our students with self induced mental illness! You will participate in their mental illness fantasy, or be punished.”

Actually, the reason we are suffering from this liberal insanity is because life is too easy. People need something to fight for, something to argue over. We haven’t had any real conflict...some need to fight for survival. So, people who need a bit of drama just make stuff up. I guarantee if we had a real war and it actually affected people nobody would be talking about pronouns or sex changes or trans anything.

Pronouns in my opinion should be the option of the speaker. Personal names are decided by the parent and the individual. What the teacher calls the student should be based on what name the student is enrolled under. That should be the responsibility of the parent and the administration to have that name appear on the class role so that the teacher can learn those names and not have to guess or have the name change several times over the course of one year. And the teacher isn’t making a choice that arguably violates free speech or the practice of religion if there is only one name that the student is registered under, whether it is Bob, Sue, Pat, Chris, or something unpronounceable.
