In the end, Galo served only 43 days in jail in 2012, on charges of crime of moral turpitude and driving without a license. Rosenberg was told Galo wouldn’t be deported because “crime of moral turpitude.” An illegal alien does not need any conviction to be deported, they are here 'illegally'.
The "crime of moral turpitude" only comes into play when you are dealing with a legal permanent resident. Vehicular homicide IS a crime of moral turpitude so this guy was eligible for removal on two counts.
As as matter of fact and law the government had no legal authority to allow him to remain in the US. The statute states that the government 'Shall Remove' not should or can remove illegal aliens convicted of felony's.
He was a mandatory detention and removal.
