Family of teen run over by stolen car want owner who had vehicle stolen held responsible for the death

AURORA, CO – Losing a child is difficult, regardless of age.

Often grieving families turn not only to legal recourse, but also civil lawsuits against those responsible.

However, in a case out of Colorado, the grieving family who lost their teenager who fell out of a stolen vehicle which ran him over is seeking civil relief from the victim of the car theft.

The incident when the teenager was killed occurred on October 18th in Aurora, Colorado at Village Green Park.

The Aurora Police Department reports that 14-year-old Kashontez Grigler was riding as a passenger in a van which was stolen by his girlfriend.

Grigler was allegedly hanging on the front of the stolen minivan and fell off, causing the stolen vehicle to run over him. The girlfriend and driver of the stolen van took off on foot but later returned to the scene.

Kashontez’s father, Kasseem Grigler, spoke about the enormous loss of his son:

“It’s hard to cope. We haven’t had his funeral services yet. Until we can get that under control, it’s going to be hard to move on…It hurts, it’s hurting all of us.”

Kasseem said that Kashontez’s girlfriend, the one who allegedly stole the van, is also hurting over what he terms as an accident. He said:

“She [the girlfriend] was my son’s homecoming date. It’s not even easy for her. They were friends and it was an accident.”

Three kids were involved: the boy who died, his girlfriend, and another teen.

Frankly, it sounds to me like the other teen and the girlfriend were stealing the van and the boy who was killed was trying to stop them by hanging on the front, assuming they would stop...

If your car is stolen due to your own negligence, you can be held liable for damage caused by the thief. This case is unusual in that the victim was a participant in the theft, to some extent. I’ve heard of cases where a person perpetrating a crime has sued the victim because for negligence when they have been injured on the victim’s property. My all time favorite was a case where an electrician was trying to steal high voltage copper wire and was electrocuted. His estate sued for workers compensation payment to his family. The court threw it out, stating that theft was not one of the victim’s assigned duties.

I believe a car is insured, not the driver. So, order of precedence is car owner, driver, anyone within 50 feet of the accident with deep pockets. My guess is they get paid something on this. If it went to court and I was on the jury, they would not get one cent but as someone said above, the insurance company may not wish to take the risk and settle for a medium amount. Sad.

Might? The article makes it seem as though the civil proceedings are already in the works. Which means a lawyer has already taken the case. They will go after the owner’s insurance company. Those are the only deep pockets in this case. Hopefully the plaintiffs will lose badly.

Well there is also the case to be made that the young man is responsible for his own death by being so er stupid as to attempt to hang onto the front of a moving vehicle

Are you sure of that? This article is all over the place.

Yes, if he was hanging on the front he COULD a have been trying to stop her/them. Or just incidentally was there when she/they punched it.

Not clear at all what happened. The dead boy could have been totally innocent.

....it was an accident.

That says it all. The car stole itself with two teens who happened to be sitting inside by no fault of their own. The parents should be euthanized for even thinking that.

No sympathy for stupidity.

In some places it’s illegal to leave a vehicle running or with an unlocked key. You can receive a ticket.

So there is some precedent for an owner being required to lock up their vehicle
