Baltimore man who fatally shot man in the back makes self-defense claim to grand jury. And wins.

Maurice Timothy Jones, 35, was charged last month with fatally shooting 31-year-old Seth Tunstall on Sept. 7 outside of a convenience store in Cherry Hill. Surveillance video showed the two had engaged in a fist fight; Jones left the store, and was pursued by Tunstall, who emerged pointing a gun at him. When Jones drew his own weapon, Tunstall attempted to flee and was shot in the back.

Werent we assured if Rittenhouse was black, like Jones , things would be different? Instead the grand jury here didnt even allow it to trial.

So what is the law regarding shooting another who is attempting to flee? I thought if a person is trying to run from a confrontation then shooting them is a felony and not self defense.

If you are chasing someone you assume is unarmed with your gun out you do not get to just stop and say, "oh sorry, didn't mean it," when he pulls his own weapon.

The fact that you were pursuing him makes you a clear and present danger.

Jury got it right.

Cherry Hill is almost 100% black and section 8, I use to drive a cab in the baltimore area.

the prosecutor tried that 'Kyle shot him in the back' crap at Rittenhouse's trial.

The perp was shot in the back only because he was lunging forward to grab kyle's gun and as he fell forward horizontally one round entered the back of the perp's shoulder and exited at his hip.

But it sounded very dramatic during the prosecutor's opening statement when he said "the state will show that Kyle Rittenhouse shot a man in the back."

1. Your local law may vary, but if they are fleeing, it’s probably a felony. In the middle of the action, can you tell for sure if they are fleeing or going for a better position?

2. In the middle of the action, your brain can send a signal to squeeze the trigger at about the same time his brain sends a signal to flee resulting in a shot in the back before you can stop the squeeze.

Fleeing felon rule. Hard to get a conviction for shooting an armed person even if fleeing the scene. In this case the deceased had pointed a gun at the shooter, a felony.

Your example #2 is exactly why the cops involved in shooting Saint Jacob Blake (the excuse for the Kenosha riots) in the back were likely justified. The reasons:

  1. St. Blake was a known felon whom the cops were responding to a call on a sexual assault.
  2. St. Blake was reaching for his weapon.
  3. It is damn near impossible to ensure your own survival by allowing a known violent felon the opportunity to take the first shot or stab, as the presstitutes think the cops should have done.

If the person is still armed while running, they are just changing position. They are still a danger even at more distance.
