Sure there is. It doesn’t mean they’ll win but they can absolutely do it and ruin the kid’s life with another five or six years of courtrooms and legal processes not to mention holding him in Federal prison without bail. They can do all of that.
They can charge a ham sandwich, but you at least something to support it.
It is not there. It never was. Even the dishonest prosecution team in the state case never alleged it.

Can they though? Wouldn't it be hard to justify holding without bail when he's been out on bail for months without any attempt to flee, threaten others, etc.?
Seems like they'd at least have to check some boxes so a judge could approve. And seems like those boxes would be especially hard to check in this situation.
