Sure there is. It doesn’t mean they’ll win but they can absolutely do it and ruin the kid’s life with another five or six years of courtrooms and legal processes not to mention holding him in Federal prison without bail. They can do all of that.
Can they though? Wouldn't it be hard to justify holding without bail when he's been out on bail for months without any attempt to flee, threaten others, etc.?
Seems like they'd at least have to check some boxes so a judge could approve. And seems like those boxes would be especially hard to check in this situation.
Look what they did to Jan 6ers for trespassing. They can do anything they want. A judge will rubber stamp it.
