While I dont like to see schools require such things of its student body any more than I like to see employers require such things of employees, I guess I would ask you or anyone else here complaining about Barrett not taking up the case on what constitutional basis would the government come in and tell a private or even state institution that this is unconstitutional? If its not in the Constitution, power is reserved to the state or the people, is it not?
I dont clearly see a federal role here. Like you have the choice to find a new job if you dont like what your employer requires, a student has the choice to go somewhere else for education as well.
If the school is getting federal dollars then there may be strings on those dollars for forms of discrimination, but the way the discrimination laws are written, I dont think discriminating by vax’ed/not vax’ed falls under those statutes.
Sorry for students at the schools who are being told this, but just like businesses getting woke and going broke, maybe this needs to happen with educational institutions as well.
I am open to here arguments why USSC should take this. Perhaps the argument presented to USSC was not a good one and needs to be reframed as one of privacy rights or something?
