It hasn’t been fully litigated yet. But, it’s unlikely the CDC would prevail given other decisions on the limitations of federal police power.

Unfortunately, what they’ll do is ‘recommend’ the kids wear masks and then, unless the legislature/governor has enacted prohibitions on mask mandates, the vast majority of school systems, which are dominated by liberals, will adopt the CDC recommendations.

It’s going to turn into yet another blue state/red state thing.

Being dominated by liberals is a point. But in my experience most school boards are woefully deficient in members trained in either medicine or science. The Centers for Disease Control recommends something in the midst of an outbreak of a contagious disease, many if not all school boards will likely follow the CDC’s recommendation.

My local school where I sub, was in session all of 2020-2021 with masks optional. At the beginning of the year distancing was kind of maintained but as the year progressed and kids weren’t dropping like flies, this was relaxed. Made a mess of the schedule with classes coming and going at separate times, odd lunch hours, etc. Everyone was sick of it by the end of the year.
