I thought the courts had already rendered decision that CDC DID NOT HAVE SUCH AUTHORITY.....
They can recommend, not require. Arizona law forbids mask requirements by public schools. And our kids are back in school now....
It hasn’t been fully litigated yet. But, it’s unlikely the CDC would prevail given other decisions on the limitations of federal police power.
Unfortunately, what they’ll do is ‘recommend’ the kids wear masks and then, unless the legislature/governor has enacted prohibitions on mask mandates, the vast majority of school systems, which are dominated by liberals, will adopt the CDC recommendations.
It’s going to turn into yet another blue state/red state thing.
They can “issue guidelines’ but they can’t enforce them by use of traditional government force methods. The president could try something militay but the CDC itself couldn’t. They are relying on voluntary compliance and the gullible ignorance of liberal bureaucrats.
The court said the CDC has no constitutional power of enforcement or the right to use such means to enforce its edicts. It didn’t say that it couldn’t issue “suggestions” the the Feds and various states themselves could implement if they wished. So again we will see a patchwork of responses across the nation some pro CDC some not.
