Arizona Senate President: State’s 11 Electors Cannot Be Recalled After Maricopa Audit

Arizona Senate President Karen Fann, a Republican, said the state Senate doesn’t have the ability to recall electors for the Nov. 3, 2020, election, after a fellow Republican lawmaker called for new elections.

Fann told One America News Network (OANN), which has been covering the audit of Maricopa County, that the upper chamber has the ability to provide auditors with the materials they need—including through the use of subpoenas—but the certification of electors is a different matter.

“The Senate body—we do not have the authority to do that. So, this is what we have said, and I want to make this very clear on the record,” the Republican state leader said on July 16.

Fann’s comments came as former President Donald Trump issued a statement declaring that the audit revealed there were irregularities and fraud that would have swayed the election in his favor last year. On July 15, the Senate held a hearing in the midst of a months-long review carried out by Florida-based tech firm Cyber Ninjas and teams told lawmakers they discovered discrepancies.

Doug Logan, CEO of Cyber Ninjas, told senators that auditors couldn’t find any record of Maricopa County sending more than 74,000 mail-in ballots and also discovered that around 18,000 people voted, but were taken off voter rolls “soon after the election.” He also noted that there were “11,326 people who were not on the voter rolls on Nov. 7, 2020, but appeared on the rolls on Dec. 4, 2020, and 3,981 people who voted after registering after Oct. 15, 2020.”

What this means is the electors should not have been certified and the protest on Jan 6 was legitimate and necessary.

The Constitution is very clear that after Congressional review the election is over. No allowance for courts or any other determination.

Uh, where exactly in the Constitution do you read that? The Twelfth Amendment pertains to Congress witnessing the returns of presidential electors from the states. It does not pertain to fraudulently appointed electors or what to do when they are later discovered, and makes no mention of governors certifying elections. So what is not denied to a state, is reserved by the Tenth Amendment. Thus, the state, acting through the appropriate state officer, has the right to seek a remedy in the U.S. courts. By statute, the writ of quo warranto is filed in the U.S. District Court for the District of Columbia. If a state is a party to that action, Article III, Sec. 2 combines with the All Writs Act to enable SCOTUS to decide the case with its original jurisdiction.

Weeks wasted on the audit, and now this comes out. The DEMs are laughing their asses off. No one is touching them or the 2020 election.

“But they were not fraudulently appointed” is the argument that states will make. I believe the states win that argument.

And what to do “when they are later discovered” assumes that discovery is sanctioned by the state. It’s the same slight of hand used by those claiming (wrongly) that some states sent competing slates of electors. No, they did not.

If we didn’t live in George Orwell’s 1984 the sentence above would just be another sentence in a news article - but since we do live in Orwell’s 1984, I’ll translate it to how our media would have written it:

“Fann’s comments came as former President Donald Trump issued a statement FALSELY declaring that the audit revealed there were irregularities and fraud that would have swayed the election in his favor last year.”

It won’t be occurring because the GOP wants Biden to be POTUS. The bipartisan nature of the coup won’t be changing after 5 years.

Actually, the Constitution doesn't call for a general election in the first place, and in fact since the process of chusing Electors is a reserved State power, even if there are to be elections, there are 51 of them, not a "general" election.

I believe there’s a lot of truth in what you write. One need only look to repeal of a Obamacare as a fund fundraising tool prior to the 2016 elections. Votes to repeal in the House, knowing full well it was not going anywhere. Then when Republicans had control of both chambers and the Presidency, excuses about how it was tough to repeal, etc, etc.

Lots of talk. I think the status quo was preferred.

Actually, the Constitution doesn't call for a general election in the first place, and in fact since the process of chusing Electors is a reserved State power, even if there are to be elections, there are 51 of them, not a "general" election.

Actually it does, for Senators and Congressmen. All the states and DC have decided to allow the voters to also select the electors for president and vice president and use the same election day for that.

Where in the Constitution do you read that?? I thought the Constitution was silent on that subject.

And in matters where the Constitution is silent the Constitution says the States take responsibility. (10th Amendment)

I don’t know if anyone here has worked in project management, but there has to be a process.
