First, I can see a smart employer reading this dopey ruling, and simply send a blast email to everyone with a spreadsheet with has a YES, NO, NOT SURE, and CHOOSE NOT TO DISCLOSE radio buttons, and ask the people to send them all to an HR mailbox. Maybe they'll get around to collecting the replies. Voila - compliance!
Second, there is undoubtedly a govt-influenced discrimination potential with this guidance. Will employees now exclude other employees from outings, lunches, drinks etc because of John or Mary's vaxx status? Will there be cliques of the vaxxed vs unvaxxed employees?
This all will lead to lawsuits by wokey employees against employers under discrimination statutes. "You should have made Jack wear a Scarlet V on his badge since he isn't vaxxed but since you didn't I got the bug from him....it's all your fault."
Why, it's almost as if the government WANTS this bedlam...
