Attorney Eric Nelson has filed a motion for a new trial for former Minneapolis police officer Derek Chauvin in the death of George Floyd.
Nelson filed the motion on the grounds of juror misconduct, and that the court abused its discretion for failing to agree to the defense’s requests for a change of venue and sequestering the jury.
The filing comes in the midst of a controversy surrounding a photo of juror Brandon Mitchell at the March on Washington last August, which included speeches from George Floyd’s family members. He is seen wearing a T-shirt that says “Get Your Knee Off Our Necks.” In his juror questionnaire, Mitchell wrote that he had not attended any protests over police brutality. Mitchell told WCCO Monday that he was at the march in support of ramping up voter turnout for the 2020 presidential election.
“Either way, I was going to D.C. for this event, even if George Floyd was still alive,” Mitchell said.
On April 20, the jury in Chauvin’s trial found him guilty on all three counts of second-degree murder, third-degree murder and second-degree manslaughter.
It took the jury roughly 10 hours of deliberation to reach their verdict, including about four hours on the first day and another six hours on the second day.

Well the first appeal is an appeal of right and so the court- whichever is the next step in the process - has to accept it. They can rule against, but they have to take and hear the case.
Don’t be foolish. Imagine if Chauvin’s lawyer had filed this motion BEFORE the revelation about the BLM juror had come out.
No surprise, he’ll be rightfully convicted again, better if honest and fair justice.
Alternates do not go in for deliberation nor do they have a vote.
According to the court decision the death penalty was tossed because the trial judge had excluded jurors who were against the death penalty.
so with the Chauvin trial, the whole case can be overturned because the juror lied..will it happen, who knows

I dont know if they can petition the court to do this but if they can, they should request the trial judge to bring charges of perjury against that juror.
Not so sure about that. It could’ve easily been blamed on Maxine waters.
And maybe got some of them to shut the heck up.
Good to see that Chauvin’s lawyer is putting the Democrat Judge on the hot seat immediately.
I’m hoping that the Judge is embarrassed enough by this BLM ahole that he brings the hammer down.
I really think the left wants another trial, too. They put a lot of effort into making Floyd a hero martyr - and they'd love to do it all over again next year.

If they can get jurors to obey them through threats, why not voters? A new trial would be a ready-made campaign issue.
Cahill won’t bring the hammer down. He has feet of clay and proved it time and time again during the trial. BUT there’s a chance, maybe a slim one but a chance nonetheless, that at some appellate level this travesty of a case comes before some judge(s) with integrity and then all bets are off.

The Supreme Court has zero jurisdiction over this case. Not that it would matter anyway...
