A Chicago-based prosecutor was placed on paid leave Friday for failing to mention in a statement that Adam Toledo, 13, had dropped the handgun he was holding before he was shot by a Chicago police officer, the Cook County State’s Attorney’s office announced.
"In court last week, an attorney in our office failed to fully present the facts surrounding the death of a 13-year-old boy," State’s Attorney Kim Foxx’s spokeswoman Sarah Sinovic said Saturday. She was referring to an April 10 hearing, according to the Chicago Sun-Times.

And his “tossing” of the weapon happened in the split second his right hand holding the weapon was blocked from the field of vision of the cop as the perp simultaneously rotated his body to face the cop and raised his right hand.
For Monday morning quarterbacks who fault the cop for this justified shooting, I have a good idea of where you’d fall in the street’s “the quick and the dead” continuum.

Yes Toledo pulled the weapon out with his right hand and the officer saw the it - and 2 seconds later shot the kid.
2 seconds - just about the right amount of time it might take a police officer in a foot pursuit to pull his weapon and fire.

True, when the round hit him he was not armed. A second earlier he was armed when he made a motion like he was going to shoot to try to throw the gun, which promoted the officer to shoot.

And also the gun was in the slide locked out position - indicating that the magazine was emptied before hand - ie. the 8 shots fired at the car.

My liberal friends always say the child didn’t have a chance or we need to protect the children. So this kid was 13. I grew up in Chicago and in 7th grade I was not too far from this incident.
The first gang fight I remember was between 6th and 7th graders over a pushing incident that happened in a park after school. The “children” got chains, bats and sticks and were going to fight it out in an alley - the time and date mutually agreed on. The fight started and a resident call the police and within minutes the police came and the kids ran and I think nobody was caught. This is the city of Chicago not Mayberry and gangs have been around since forever - even in Rome there were street gangs. Gangs are nasty and dangerous but that is the attraction.
