LIVE VIDEO: Derek Chauvin will not testify, defense rests case

The court has convened for the day.

Chauvin has made the court aware that he will not testify in this case, choosing to invoke his Fifth Amendment privilege.

The defense will rest its case Thursday with the state planning to call rebuttal witnesses to address some "newly discovered evidence."

State prosecutor Jerry Blackwell says the state has blood gas evidence from Hennepin County "that would contain blood gas reading for the carbon monoxide content in Mr. Floyd's blood on May 25, 2020." He adds the state was just notified of this evidence on carbon monoxide Wednesday. According to Blackwell, Hennepin County Medical Examiner Dr. Andrew Baker discovered it.

Here in downtown Minneapolis, there has been a definite speeding up of storefronts being boarded up.

At my workplace, we’ve heard nothing official about what to do in the event a verdict is reached during work hours or for that matter, whether to come in to work because of possible unrest. I’m sure we’ll hear something.

One way or the other, Chauvin will be found guilty of at least one charge. Hard to say which one though. The defense didn’t (IMHO) do that well yesterday when they brought their forensic pathologist on to testify. in baseball lingo, they didn’t need a homer but a double or triple would have been nice.

Judge said no deliberation until Monday, as he didn’t want to have to sequester the jury unnecessarily this weekend. Riots mid-week next week, maybe next weekend if the jury is actually seriously discussing this case and not just offering up the cop as a sacrificial lamb.

..suppliers type up whatever the spec calls for, hand it to the engineer.

Really? I thought their witness - Fowler - did incredibly well. He was solid on direct and cross-examination was a big nothingburger for the state. He was the only witness where I watched (almost all) his the testimony live during the trial. But, compared to other clips I’ve seen of the state’s medical/scientific experts, I thought Fowler was appreciably better in every way. Plus, with experience at the FBI and Johns Hopkins, his CV is sterling.

With respect to what the jury will do, it’s really hard to say. If they’re intelligent, circumspect people who put civic responsibility ahead of personal fear, Chauvin is found not guilty.

Absent those characteristics in all 12 jurors, really anything is possible...as the OJ trial capably demonstrated.

Normally not testifying is the best approach. However his failure to testify will be read by the jury as a tacit admission of guilt. They can now assume he had evil intentions. And they will.

I have no idea what constitutes reversible error when a judge decides to not sequester a jury. But, in the history of famous US trials, this is probably near the top of the list. And, when accounting for protests and riots in advance of and DURING a trial, this case is easily without an equal.

IOW, if this case didn’t merit a sequestered jury, no case has ever merited a sequestered jury.

Yeah a cop unwilling to testify to clear his name will weigh in with the jury, reasonable doubt wont be enough to get him off with this atmosphere.

The riots will happen either way. There are those who very well may be killed, seriously inured or lose their business or home. Treat it like a Cat.4 Hurricane Warning and it’s advisable to GTFO if one can or weather the storm.

I dunno. My read on this is that Chauvin will be convicted this jury and the strategy is to get the conviction overturned on appeal. This is going to be ongoing for years.
