This does not bode well for the defense. Minnesota says that murder in the 3rd degree is “Whoever, without intent to effect the death of any person, causes the death of another by perpetrating an act eminently dangerous to others and evincing a depraved mind, without regard for human life, is guilty of murder in the third degree”
So no intent needed, but have to show a) depraved mind and b) without regard for human life
Not as big a lift for the prosecution, and gives the jury an out. Seems very unfair to spring this on the defense a couple of weeks before trial, in any case.
I think he should walk, but the jury may go into John Roberts mode and sacrifice Chauvin to appease the barbarian hordes.
