The Senate voted Tuesday to move ahead with the unprecedented impeachment trial of former President Trump after listening to hours of arguments on whether it is constitutional to try a president who is already out of office.
The vote was 56-44.
Trump's legal team said the trial is unconstitutional because he's no longer in office and can't face removal, which is the standard judgment of an impeachment conviction.

Isn’t Cassidy from Louisiana? John Kennedy needs to give him a good ol’ “Baton Rouge” upside the head.....coward!!
Ok, so get Robert’s in there to preside.
11 more. Impeachment needs 67 votes
He needs to get to 67 so he needs another 11 Republicans in addition to this if Cassidy thinks in fact Trump incited this
Sasse spends most of his time in Congress being impressed with himself. Some of the things he says might sound right, but he's not saying them to influence you, but rather to dazzle you with his self-absorbed and self-involved awesomeness.
Some men like this spend a lot of time in front of a mirror. Sasses spends most of his time listening to his own blather...
Cannot wait for the “lets back our GOP” crowd to come and tell us how great that party is—
We have been betrayed again, the UNIPARTY lives!
He needs 67 to convict, not 62.
Eleven. Takes 67 to convict. Though if today is a good indication on what his legal team is like then Senators may vote to convict just to get it over with.
why won’t they? the dems have the majority with a Harris tiebreaker.
They want to cancel Trump’s Secret Service protection and they want to do it for a reason.
Roberts already ruled on that, didn't he?
Justice is going to be so much better now that the legislative branch took over. The Supremes can just take a break until they're needed again - when there's a Republican in the WH (if that ever happens).
Let's call them what they are.
Traitorous Democrats!!
This vote is a major blow for the managers. They didn’t flip retiring members like Portman and Burr, they didn’t flip GOP leadership... a conviction now extraordinarily unlikely.
More fantasy Senate shenanigans.

That I wasn’t aware of.
Quislings
Apparently. That’s a shame that his actions don’t match his words.
Not really....but rant on.
You’re right. The Republicans can impeach Clinton (again) or Obama. The 3 plane loads of foreign currency being sent to Iran while Iran was under U.S. sanctions comes to mind.
They are duplicitous. Not an honest bone. Not one.
First impeachment, "rule of law" whistleblower, outside of statutory jurisdiction, ZERO Senators questions the conclusion that ICIG Atkinson had jurisdiction.
The federal government is rogue, enemy of the constitution, enemy of liberty. Doesn't even follow its own rules. Banana Republic. An inevitability.
