Senate votes Trump impeachment trial is constitutional

The Senate voted Tuesday to move ahead with the unprecedented impeachment trial of former President Trump after listening to hours of arguments on whether it is constitutional to try a president who is already out of office.

The vote was 56-44.

Trump's legal team said the trial is unconstitutional because he's no longer in office and can't face removal, which is the standard judgment of an impeachment conviction.

Ben Sasse surprises me. When I have heard him speak, he’s always come across as Constitutionally minded.

Sasse spends most of his time in Congress being impressed with himself. Some of the things he says might sound right, but he's not saying them to influence you, but rather to dazzle you with his self-absorbed and self-involved awesomeness.

Some men like this spend a lot of time in front of a mirror. Sasses spends most of his time listening to his own blather...

Eleven. Takes 67 to convict. Though if today is a good indication on what his legal team is like then Senators may vote to convict just to get it over with.

Gee, I always thought the Supreme Court was the one to decide what was constitutional or not.

Roberts already ruled on that, didn't he?

Justice is going to be so much better now that the legislative branch took over. The Supremes can just take a break until they're needed again - when there's a Republican in the WH (if that ever happens).

This vote is a major blow for the managers. They didn’t flip retiring members like Portman and Burr, they didn’t flip GOP leadership... a conviction now extraordinarily unlikely.

You’re right. The Republicans can impeach Clinton (again) or Obama. The 3 plane loads of foreign currency being sent to Iran while Iran was under U.S. sanctions comes to mind.

First impeachment, "rule of law" whistleblower, outside of statutory jurisdiction, ZERO Senators questions the conclusion that ICIG Atkinson had jurisdiction.
