State Senate On Target To Vote Monday On Contempt Action Against Maricopa County Board (Can Make Arrests)

The full State Senate could vote as early as next Monday on a resolution to hold the Maricopa County Board of Supervisors in contempt for failing to comply with two legislative subpoenas issued last month related to the 2020 General Election, the chairman of the Arizona Senate Judiciary Committee announced Tuesday.

“The resolution is being introduced and is expected to have its First Read on Wednesday,” Sen. Warren Petersen told Arizona Daily Independent. “It could be on the Senate Floor as soon as Monday.”

The resolution can pass with only a simple majority of the votes, which is 16 of the 30 senators. Petersen said it would then be up to Senate President Karen Fann to exercise her contempt authority to call for the arrest one or more of the five Maricopa County supervisors.

Petersen’s announcement came after the Maricopa County BOS held an emergency morning meeting to address what has been characterized as a final demand by Fann and Petersen for county officials to provide a timeline by Noon on Tuesday of when the subpoenas would be complied with.

The BOS convened around 11 a.m. for less than 90 seconds before going into a non-public executive session. The supervisors did not come back into open session, but BOS Chairman Jack Sellers later said the county continues to reject the Senate subpoenas.

Among the items included in the subpoenas are the county’s voting system equipment, voter registration records, election system software, and even the 2.1 million ballots cast in the Nov. 3 election. The intent of the audit, Petersen said, is to look at all facets of how the county managed the election, from before ballots were mailed out through to the tabulation.

“It is truly unfortunate that today Maricopa County has refused to comply with the subpoena and allow the Senate to conduct a forensic audit of the election,” Petersen said. “There is no legal consequence if they allow us access to the machines and ballots. However, there are serious legal consequences for failing to comply with the subpoena.”

The power of the Arizona Legislature to issue and enforce subpoenas was the subject of a December 2020 legal briefing by the Arizona Attorney General’s Office. In the brief, Deputy Solicitor General Michael Catlett argued the legislature has “broad authority to issue and enforce legislative subpoena,” including the “authority to investigate” how Maricopa County administered the recent election.

“Separation of powers prevents one branch of government from usurping powers of another coordinate branch of government or delegating power to another coordinate branch,” Catlett noted in the brief. “Separation of powers does not, however, insulate a subordinate division of government (like the County), which derives its powers from the Legislature, from oversight in the administration of something as fundamental to American democracy as elections.”

Under Arizona Revised Statute 41-1155, anyone issued a legislative subpoena who then refuses “to attend, or to be examined as a witness, either before the house or a committee, or before any person authorized by the house or by a committee to take testimony in legislative proceedings” may be punished with contempt “and by imprisonment.”

And under ARS §41-1154, a person who “knowingly fails or refuses without lawful excuse to attend pursuant to such subpoena, or being present knowingly refuses to be sworn or to answer any material or proper question, or to produce, upon reasonable notice, any material and relevant books, papers or documents in his possession or under his control, is guilty of a class 2 misdemeanor.”

The Maricopa County BOS is not scheduled to meet again until Feb. 8. The supervisors and other county officials are receiving legal advice on the subpoena issue from in-house counsel at the Maricopa County Attorney’s Office as well as private lawyers paid for by taxpayers.

Legislature has Sargent at Arms but not state police. State police need a court order.

Legislature won in court January 20, two weeks ago.

But Maricopa County chose to play more games afterwards.

So now legislature goes to court with resolution for contempt, then Judge orders police.

I’ve been working with state governments for the last 30 years and I’ve never seen one state watch another “closely.”

In my experience, states make their own decisions and listen to what other states do with (very) mild interest.

Each state has its own constitution and is responsible for its own elections.

And that’s a good thing. If the fed centralized elections they could be corrupted at a single point.

The story notes that the legislature has the authority to arrest. Who should make the arrest - the Salvation Army?

I didn’t see that in the story. I understood the Court that upheld the subpoena will hear the legislature’s argument for contempt and upon finding contempt will issue an order to seize all materials described in the subpoena with possible arrest of those in contempt. The Judge’s order can cause arrests to be made.

The members of the Maricopa County Board of Supervisors must comply with the Court’s order or face arrest. They are all facing recall as it is.

I just heard Tom Finchum on Bannon’s War Room that the ballots have not been in possesion of the State Treasurer, as required.

So, by now they may have been “fixed”.

Here are some nuggets to dig on:

Each printed ballot (or any printed paper in general) has microcodes printed on its paper by the printer. This microcode is invisible to the naked eye. Jovan in one of his many, many videos exposed these codes under a scanner that enlarged them.

These microcodes are alphanumeric and are reported to be required by law as an anti-counterfeiting measure. These codes trace the printed paper to the printer it was printed from. Further, the printer can have its location traced. Most every printer today is equipped with wireless comms.

Another nugget is that the failure of turning over the paper ballots to the AZ Treasury is a Class C felony.

Another nugget is that the paper ballots among other things were under legislative subpoena and this subpoena was upheld in a court of law. Why does this matter? It matters because any spoiliation of evidence in this case allows claims by the moving party to be entered into record. In other words, you destroy or alter evidence under subpoena and you’re guilty period.

So no matter what the clowns on this county board do, they are screwed.

In my view, they thought any investigation would be under their control and confined mostly to Dominion machines which Dominion technicians could ‘fix’.

If the ballots are “lost”, there are no micro dots to prove they were fraudulent. The Dems and the media can then say ok, there was a screw up and they were lost, maybe someone needs to be fired for that, but you have no proof the election was stolen (etc).

Not true.

Lost ballots are de facto spoiliation of evidence. Therefore, the hundreds of affidavits attesting to election theft and voter fraud are taken at full value allowing for judgment to infer guilt.

Lost ballots are a state and federal crime. Ballots must be protected and preserved 22 months by federal statute, 24 months by AZ law.

I know, I know, but we are law abiding citizens. Dems break laws with impunity and the media will help them, saying there is no proof, show us the fraudulent ballots, you’re affidavits are not really evidence. For them, even video tapes can be brushed aside. Of course, I hope I am wrong about this.

Not at the state level.

Federal level is enemy territory.
State level is still safe in most states.

If you’re on the ground in AZ, you would feel the outrage and would know this county board is done for. Follow fir example, Doug Finchum to understand. He’s on Steve Bannon’s War Room and also found on GAB @AZhoneybadger.

AZ is boiling mad. Other states are following AZ.

Looking at the federal level, it’s easy to see why people can think the way you do.

Don’t absorb narratives from federal level including national media. Focus on State Level.

Thanks for weighing in. I am at the wishing well and hoping that this AZ thing will be the crack in the dam. Actual evidence in a court of law. Dominion gets outed and used as reason to open the can of worms.

Methinks the MCBOS is completely compromised. Discovery and convictions.

Forget Dominion, ES&S, others like them.

They are not important AT THIS JUNCTURE. They serve as a distraction. If the paper ballots can be accessed, AZ lawmakers will circle back to Dominion and nail them. IOW, they come later.

WHERE ARE THE PAPER BALLOTS?

More specifically, where are the paper ballots for Maricopa County?

They were supposed to be handed over to the County Treasurer by state law, failure to do so is a class 3 misdemeanor.

And according to the AZ state legislature the Maricopa County Treasurer said he never received them. I believe this County Treasurer was Mr. Royce Flora who resigned 12-30-2020 citing a “toxic environment” in county government.

Awesome. The ball is finally moving. Like I stated, I hope this AZ gets to nail down solid evidence of the fraud. The MSM will go into overdrive trying to spin it into a nothing burger. Question is, what next? I will bet a six pack that many if not all of MCBOS are compromised.
