But he is not a tragic figure and never will be. That though seems to be the cut of Mr. Byrne’s jib. I disagree.

I don't think Mr Byrne sees Trump as a tragic figure. I think Byrne believes what happened at the END was tragic, and he IS correct if even half of this story is true. Here is the President, loved and voted for by tens of millions, but in his moment of need he is failed (stabbed in the back?) by those closest to him professionally and his (hopelessly useless) pal Rudy.

I still think Powell got caught up in the moment - the Kracken comment and countless times she was on TV swearing she's not trying this case in the court of public opinion, torpedoed many people's opinions of her. Including me...I want my lawyer to be competent, not a showboater. That's why I believe Byrne gravitated to Powell...affinity-bias.

That said, the strategy of litigating six counties where they (allegedly) had great prima facie evidence seems the best approach. I disagree with the 75% success assessment, but it sure seems (in retrospect) more likely than letting Grandpa Rudy sweat hair dye as he dies on the 14th Amendment hill.

Innocent men get put on death row, so I am not surprised by injustice. Usually, that's a result of fabricated evidence, overzealous prosecutors, or poor defense counsel. But if the innocent man is screwed intentionally by his own defense team, THAT is a tragedy.

One of the things that I learned from this four year experience is that the most important cabinet member is the Attorney General. Whoever it is must be loyal and competent.>>> Then fire everyone in the State Department, DOJ and CIA.

This account is very credible. More is needed from the insiders about why Powell never got her office in the WH. The hostility that Powell and her assistant got from Cipollone and Giuliani explains a lot.

“Cipollone was being purely obstructionist.” Cipollone was not acting in logical or ethical ways.

In short, Trump was surrounded by people looking to cash in on their WH service, and didn't want to lose the fat salaries they had lined up. Trump should have fired them all after the election.

Cipollone's comment that he wasn't the campaign's attorney completely misses the point that POTUS has obligations to defend free and fair elections, from both domestic cheats, and foreign actors. IMHO the first mistake was not contesting the congressional results in suspect places. The Dominion cheating in MI came from discrepancies in a school board election. That showed that it was cheating at the presidential level as well. The PR issue could have been addressed by making the point that the cheating wasn't just for president, and POTUS is under an oath to protect and defend the constitution, the Equal Protection Clause, etc.

The author states the Insurrection Act wasn't discussed, just the E.O.'s. He isn't a lawyer and appears not to understand that those EO's need to have a constitutional or statutory basis to be valid. The Insurrection Act is one possible basis.

Lastly, Trump was too loyal to Giuliani. Powell was the sharper, more competent of the two by far. The hostility of the male attorneys to Powell and her able assistant comes across as sexist.

Like I mentioned before, the main mistake was to allow the cheating to happened. It should be anticipated and prevented! In the election, preventing the fraud is by far the best defense, no ifs or buts.

It used to be that Democrats miraculously won every tight race ever. Then finally the Republicans got smarter and since 2000 developed their own Lawyer teams and started winning some of those. The house elections in Iowa and NY this time are some examples. So Republicans are more less OK fighting the small wars in tight races now.

But, I do not think anybody anticipated that wholesale brazen fraud as was in the presidential election.
That was really unprecedented.
From now on it has to be anticipated! The future of our country depends on it.

A fascinating read and not really a surprise. It seems implied that Rudy threw down the gauntlet; he was the only one POTUS refused to criticize. As I say, not really a surprise except the part about Rudy.

Before posting, I had looked a little deeper at the attorneys who represented the President as Chief Counsel. Here are some interesting dots:

Pasquale Anthony "Pat" Cipollone (born May 6, 1966) is an American attorney who served as White House Counsel for President Donald Trump from December 10, 2018 – January 20, 2021.

He was a law clerk for Judge Danny Boggs of the United States Court of Appeals for the Sixth Circuit from 1991–1992, and served as an assistant to Attorney General William P. Barr from 1992–1993.

Cipollone was a partner at the law firm Kirkland & Ellis. He succeeded Don McGahn who left office on October 17, 2018. On January 31, 2020, it was reported that Cipollone was present at a May 2019 White House meeting where President Trump directed his national security adviser John Bolton to "extract damaging information on Democrats from Ukrainian officials.

In January 2021 Cipollone was present at a White House meeting to discuss whether Trump should replace acting attorney general Jeffrey A. Rosen with Jeffrey Clark, the acting head of the Justice Departments Civil Division, who unlike Rosen was willing to pursue Trump’s claims of election fraud and take other actions to help Trump overturn the 2020 election results. Cipollone reportedly argued against replacing Rosen, and strongly objected to a letter Clark wanted to send to Georgia state legislators urging them to void Biden’s win in their state. One official later said, "Pat pretty much saved Rosen’s job that day."

Donald Francis McGahn II (/dɒn məˈɡæn/; born June 16, 1968) is an American lawyer who served as White House Counsel for U.S. President Donald Trump, from the day of Trump's inauguration through October 17, 2018, when McGahn resigned.

After graduation from law school, McGahn worked in campaign finance law at the Washington, D.C. office of law firm Patton Boggs.[15] From 1999 to 2008, McGahn was chief counsel for the National Republican Congressional Committee (NRCC).

McGahn personally recommended Trump nominate Neil Gorsuch to replace Antonin Scalia and Brett Kavanaugh to replace Anthony Kennedy on the Supreme Court. Gorsuch's first official interview with Trump staff was on January 5, 2017 when McGahn met with him in Trump Tower. Trump and McGahn met with him on January 14, 2017. McGahn called Gorsuch on January 27, 2017 to tell him that he had been selected as the nominee.[27] Gorsuch was sworn in on Monday April 10, 2017.[28] McGahn also recommended the nomination of Labor Secretary Alexander Acosta. Acosta was sworn in on April 28, 2017.[29]

According to The New York Times, McGahn conveyed instructions from President Trump to Attorney General Jeff Sessions, requesting Sessions not to recuse himself from overseeing investigations into Russian interference in the 2016 Presidential election.[31] McGahn was unaware that Sessions had already consulted with career attorneys at the Department of Justice. When Sessions informed him he had already decided to recuse himself, McGahn ceased further discussion of the topic.[32] In response to this, Walter Shaub, former director of the United States Office of Government Ethics, said McGahn had "done much to undermine anticorruption mechanisms in this country." Shaub said, "It is a crime for a federal employee to participate in a particular matter in which he has a financial interest."[33]

In January 2018 The New York Times reported that in June 2017, the president asked McGahn to instruct top Justice Department officials to dismiss special counsel Robert Mueller, and that McGahn refused, instead threatening to resign.[34][35][36][37][38]

In November 2018 it was reported that in spring 2018, Trump told McGahn that he wanted the Justice Department to prosecute Hillary Clinton and James Comey. McGahn told Trump that he had no authority to order a prosecution and that while he could request an investigation, that too could prompt accusations of abuse of power. McGahn had White House lawyers write a memo to Trump warning that if he asked law enforcement to investigate his rivals, he could face possible impeachment.[43]

According to Mueller's final report, McGahn complained to White House chief of staff Reince Priebus that Trump was trying to get him to "do crazy shit." The president responded that McGahn was a "lying bastard."[45][46]

All I know about Byrne is that he is a self grandizing media whore. He created a halfassed online store that he sold for bucks, and then became Mr. I know everything about elections. Then when the judges do everything to keep Trump from exposing voter corruption, he stops looking into it decides to write kiss and tell tomes on how everyone was a douchebag but him....yet he contributed nothing to the defense but interviews to the media!

If you read my commentary sprinkled across Chapter 1 and 3 (I'm not blaming you for not doing so...I'm not that interesting) you'll find yours and my characterizations being in adjoining zip codes. He clearly is full of himself. While he went on a block chain safari, Overstocked.com imploded. He may also be on the spectrum.

But he may also be right.

Byrne does NOT claim to be the ONLY guy who got it...clearly he is aligned with Powell and Flynn, and a few others. In fact he is pretty deferential to Powell (though I chalk that up to affinity-bias...I think Powell is a showboater and maybe slightly kooky).

...but his ACCOUNT doesn't ring hollow. I've been in "war room" situations and what he describes (along with law firm management) is pretty spot-on with some of the sloppy ones I've observed. Trump's over-reliance on his long-time buddy Hair Dye, Esq. also is par for the course with many executives; it's Trump's Achilles.

Finally, if it's all BS, Byrne would be sued. If it's not BS, then it sort of proves his mismanagement thesis: any well-run operation would have EVERYONE sign an NDA.
