Well, I’ll cross my fingers. But my faith in the courts and in the Rule of Law is much diminished these days.

Not if you are being accused of lying about the machines connecting ability to the internet, its adjudication process and alogorythm capabilities. Dominion will never let this get to trial. But
Dominion is being represented by a blue-chip DC law firm specializing in defamation cases (on both sides) and which has already made American Thinker cave abjectly. The idea that such an experienced law firm is unaware of how discovery works or has otherwise been fooled by their client into walking into a “trap” to unwittingly reveal a secret conspiracy to throw a presidential election strains credulity.

I am afraid you are right. We have been disappointed so many time by the corrupt legal system I dont want to get my hopes up. Any company connected enough to sell such crappy voting machines must have a lot of friends in high places.
The GA recount and re-recount were both phony ostentatious activities designed to cloud the issue. They never examine whether machines changed votes. They only recounted what was on the machines.

Not with this case. Its based on fraud. Fraud commited by the opposition device. They just cant say”hey judgie, nothing to see here! It works perfect!” If that were the case, no drug manufacture or business could really be sued. However, its possible that he could dismiss the motion to compel, but would need a real damn good reason while trying not to have a mistrial. Here is a bit on discovery:

Motions To Compel: requesting the Judge to enter an order that the other party must reply to the discovery requests. This is a pleading to the Judge, letting the Judge know:
1. That you had sent discovery requests;
2. When you sent the discovery requests;
3. What the deadline for replying was;
4. That they missed the deadline;
5. That you contacted them about thier failure to respond to the discovery(Some jurisdictions require this.);
5. That you have no alternative but for the Judge to order them to reply.
The Judge, if he finds in favor of your Motion To Compel, will then give them a “drop dead” date to respond by.
Just to go off on a tangent -- there is no excuse for not using machines that are open source and quite basic. The SW should handle positive integers which it can add together. That's it. The SW should not understand the concept of subtraction, or negative numbers, or of decimals. Voting is an additive process. Logs should be full. time stamped and impossible to delete without a big trail screaming FRAUD HAPPENED. And of course no connection to the internet. The SW should not be able to handle that.

If there were electronically flipped votes.. It would have been quite difficult to destroy the Trump ballots and replace them with the correct number of Biden ballots. maybe the voting system gave a report: We switched 20,000 Trump votes to Biden... and then bad actors did exactly that with the paper ones. But that seems unlikely.
Much more likely that large numbers of illegal votes were dumped into the system in a handful of counties. These would be uncovered by auditing signatures and auditing the voter rolls.
I was hopeful that flipped votes was a “thing”. And I certainly can’t explain the live results that were going backwards. And God bless Rudy if he can turn this into a “win”. But the odds don’t look good, IMHO. (When was the last time a Republican sprung a trap on their opponents and came out ahead? Last time DJT in 2016.)

In practice, from what I’ve read, they have to produce internal evidence, such as email or chat messages that explicitly instruct a party or parties to wipe or change the data. The burden of proof that Dominion changed anything is on Rudy and the other parties, Dominion can just hand over whatever machines they do and there is no *LEGAL* presumption that anything has been wiped or modified.
Dominion would not be doing this if they thought anything could be discovered or proven, *IF* anything was fraudulent they have long since erased any evidence and it’s up to Rudy and co to *prove* anything was changed.
At least that’s my reading of how the court system will play this out.
We will see. My guess is that info has been wiped. And when it is the media will spin it and then quit reporting it. The lawsuits will be dropped and so will the evidence of election fraud using the dominion machines. They may not even go to discovery or they will get a judge to not give them access to the sensitive info in the machines. It’s not going to be this easy. There is a truck up the sleeve.
