Yes, we can do much worse.

Throughout his career, the Chief Justice has almost always sided with the most conservative of his colleagues: Justice Kavanaugh (89%); Justice Alito (88%); Justice Thomas (85%); Justice Scalia (84%). By contrast, his alignment frequency with liberal justices is 10% or less with Justices Kagan, Ginsburg, and Stevens.

With an 82% conservative voting record in split decisions, Roberts falls just four percentage points lower than his most conservative colleague, Justice Gorsuch, according to this measure. His percentage of conservative votes in 5-4 decisions is just two percentage points lower than Justice Alito’s and two points above Justice Thomas’s. As the chart indicates, there is essentially no partisan difference distinguishing his voting record from those of Justices Kavanaugh, Alito, Thomas, and Scalia.
