New York Gov. Andrew Cuomo, a Democrat, signed legislation on Tuesday prohibiting the sale of Confederate flags on public property, including at state and local fairs.
Cuomo was well aware that such legislation is likely to fail a First Amendment test, but this did not deter him.
"This country faces a pervasive, growing attitude of intolerance and hate—what I have referred to in the body politic as an American cancer," he wrote. "By limiting the display and sale of the confederate flag, Nazi swastika and other symbols of hatred from being displayed or sold on state property, including the state fairgrounds, this will help safeguard New Yorkers from the fear-installing effects of these abhorrent symbols."
Cuomo noted that "certain technical changes are necessary" to make sure the ban is compliant with the First Amendment, which protects free expression—including the expression of hateful ideas.

Probably the biggest flaw in the US Constitution is that officials knowingly violating it face no penalty for doing so. They should be held personally liable with severe court sanction available when they violate our rights.
This is such a crystal clear violation of the First Amendment that a first-year law student would laugh. Zero chance this stands. Only remaining question is what happens to Cuomo and the legislators who passed it? Answer, of course, is nothing. Maybe the plaintiffs get their attorney fees paid for by the taxpayers.
Personally, I think passing garbage like this should - at LEAST - get you declared ineligible for public office for life. Throw in some personal sanctions like prison time and/or huge fines for knowingly passing laws that violate constitutional rights and watch how cautiously these people move in the future.

In a sane world, this mass murdering thug would already have been arrested, tried and facing a death penalty sentence for mass murder and crimes against humanity.
