Biden’s Proposed Gun Tax Unconstitutional, Expert Says

Democratic presidential candidate Joe Biden wants to put in place a tax on certain guns that people already own.

According to one analysis, the plan could cost current gun owners across the country a total of up to $34 billion.

Biden wants to enact legislation to ban the manufacture and sale of “assault” weapons and high-capacity magazines.

He also plans to include those weapons into the National Firearms Act in order to impose a $200 tax for each gun that someone possesses already.

Nicholas Giordano, a Professor of Political Science at Suffolk Community College, says Biden’s proposal goes against the constitution.

Biden argues that the National Firearms Act has been in place since 1934.

But the 1934 act and its tax only apply to when a gun is manufactured. Not to already possessed ones.

Giordano says this year’s lockdown and violent riots in cities across the United States made people across the whole political spectrum realize how important gun ownership is.

sadly, I believe you are right in your observation...there have been soooooo many instances of unconstitional acts by both parties, but no one ever goes to jail....look at how General Flynn has been treated and others as well...total disgrace....

There’s a “transfer tax” that applies any time an NFA item changes hands as well. Last I knew it was $200 for registered machine guns and suppressors, and $5 for “destructive devices”.

Destructive devices are also $200, it is “any other weapons” that are $5.

Biden’s gun plan is only unconstitutional UNTIL Biden packs the Courts.

If the above is too complicated for some people here, what I’m trying to say is that Georgia is THAT IMPORTANT - the game is over for us, our kids, and our grandkids, should that take place.

They’ll pass the tax and ENFORCE it, and they won’t give a spit about the Constitution. They’ll laugh hysterically if a Federal Judge declares it to be unconstitutional. And our heroic media, champion of freedom, will laugh with them.

I had to look up to see if a retroactive tax was even legal, and dammit, it is. Congress has done it since the 1930s. Typically applies only within the last year though.

What other rights should then be taxed?

How about we tax the right to free speech? Tax the media for freedom of the press? Or tax our right to exercise our religious beliefs?

Maybe when we’re arrested, we should have to pay a tax to plead the 5th?

When the plain text is: “... the right of the people to keep and bear Arms, shall not be infringed.”, I don’t see any court agreeing that such a tax is not infringement.

This is incorrect. The 1934 NFA tax applied to ALL SBR, SBS, machine guns, suppressors, etc. Before the 1986 ban, it was common for people to register NFA weapons that their relatives had liberated during WWII.
