Pa. Supreme Court rejects Trump campaign claim that Republicans lacked access to Philly vote count
Philly Inquirer ^

The Pennsylvania Supreme Court ruled Tuesday that Republican monitors observing vote counting in Philadelphia were given sufficient access under state law to view the proceedings.

In a 5-2 decision, the court overturned a lower court decision that ordered monitors with President Donald Trump’s campaign be allowed within six feet of tables where ballots were being tallied.

This is the same court that unilaterally changed the election law in Pennsylvania. The excuse for rewriting the law was that it was an emergency situation due to the virus. Did everyone in the Legislature die? Could it not have changed the law in accordance with the Constitution? These ‘Judges’ stole the election process under the cover of made up law. Why would they have any integrity this time?

I also wonder what contingencies there are in the state’s election law regarding counting the ballots. Are they allowed to simply stop when they feel like it? Seems that the act of arbitrarily stopping and restarting is, in and of itself, election interference. What if they decide to stop when one candidate is ahead and simply don’t count any more ballots at all (never mind any other mischief)? Where, exactly, is the red line?

The chain of custody was clearly broken once they kicked out the observers, and consequently they should not count any ballots tabulated after that point, or simply toss the entire precinct. If anybody whines about that, tell them that elections have consequences and they should hold their election officials directly responsible (criminally so) as well as whoever had supervisory responsibilities. Even if they were appointed, at some point it falls under the purview of some elected official and that official should be fully accountable.

They have to go through the state first or federal will send them there, anyway. Procedures, procedures, procedures.

“The decision was 5–2 because two justices wouldn’t have even decided the case, preferring to rule that it is moot. The principal dissent also explicitly says that throwing out valid ballots would not be an appropriate remedy anyway.”

The Chief Justice was quoted as saying, “Get some of these!” while waving a pair of binoculars in the air.

“”There have been, and will always be, some localized irregularities,” Saylor wrote of elections. “This is why courts are open throughout the election cycle, as here, to remedy these just as quickly as possible. It is also one of the reasons why we have a Commonwealth Court, with expertise in election matters, and organized to act expeditiously via single-judge consideration. ... Short of demonstrated fraud, the notion that presumptively valid ballots cast by the Pennsylvania electorate would be disregarded based on isolated procedural irregularities that have been redressed — thus disenfranchising potentially thousands of voters — is misguided.””

The dems (and dem courts) define ‘observe’ as being able to see what’s going on, as in sitting in the nosebleed seats at a ball game not actually close enough to catch someone cheating like say a referee or umpire. If the former is true, what is the point of having election ‘observers’?

Actually, they literally said that Republicans can have access they just can’t have “meaningful” access. This is the legal equivalent of giving a petitioner the finger.

Thanks, that meme idea jumped out at me while listening to Dan Bongino. That’s when I learned that

1. Both Dominion and Smartmatic are on the DHS “Center for Infrastructure Security” (hence last weeks’ “most secure election ever!” memo

and

2. Yes, Dominion and Smartmatic DO share common software.
