Suing over meaningless numbers was not about the particulars but more about getting the States to admit they changed the rules without updating their laws. That’s a no-no.
But these trivial numbers would not overcome the 5M deficit. The only way to attack that is to show the machines were defective. I think they will refile cases around the machines and the software this week.
There will be a discovery phase and evidentiary hearing. Then, and only then we the American Public really understand their case.
IMHO, they may be able to show the machines are capable of doing X, but proving that X really happened is a tough battle unless they have significant proof.

Your 5M number has no relevance in electoral college. We don't elect the president using total votes in all states. Only a SMALL fraction of a million votes was needed to be switched to secure electoral votes in swing states for a Biden win.
I have encountered that opinion before. I find it unconvincing.
We have video of the votes coming in tranches in the wee hours of the morning all for Biden w/ POTUS vote count going down. Hundreds of thousands of votes dropping when the poll workers has supposedly gone for the night.
We have affidavits of votes being put through the machines multiple times for tens of thousands of votes. There is plenty of testimony.
Most court cases do not have a video of the crime. Witness testimony and circumstantial evidence, mathematicla proof speaking to the implausibility of the distribution of votes & timing, all have their place.

Yeah cuz NatSec monitors phone calls, Siri queries, the White House toilet, BUT they ignore all of the Election Night DNS traffic to all these individual Dominion machine MAC addresses, or the Dominion / Scytl traffic in and out of the US. Yeah.
