Suing over meaningless numbers was not about the particulars but more about getting the States to admit they changed the rules without updating their laws. That’s a no-no.
But these trivial numbers would not overcome the 5M deficit. The only way to attack that is to show the machines were defective. I think they will refile cases around the machines and the software this week.
There will be a discovery phase and evidentiary hearing. Then, and only then we the American Public really understand their case.
IMHO, they may be able to show the machines are capable of doing X, but proving that X really happened is a tough battle unless they have significant proof.
