LYNCHBURG, Va., (WSET) -- The Chairman of the Lynchburg Republican Party has filed a lawsuit against the Lynchburg Registrar's Office regarding the processing of absentee ballots.
Eric Harrison, Chairman of the Lynchburg Republican Party filed the lawsuit after the Lynchburg Registrar's Office began pre-processing thousands of absentee ballots without a Republican Officer present.
"We don't file this with happiness, we're upset and saddened that we had to take this extraordinary step to file this lawsuit, but we're prepared to do what it takes to make sure that the ballots are counted fairly and that the law is followed," said Harrison.
According to the lawsuit, Christine Gibbons, General Registrar for the City of Lynchburg sent an email to the local party chairs on Monday, Oct. 26 that no pre-processing of absentee ballots would occur on Tuesday, Oct. 27 or Thursday, Oct. 29.
On Oct. 29, a Republican authorized representative observed pre-processing, and Gibbons later acknowledged by e-mail that pre-processing had been undertaken that day.
The lawsuit states that Gibbons failed to perform her duties regarding the pre-processing of absentee ballots in accord with the statue, regulation, and instructions by failing to ensure that a Republican officer of election was present during expedited procedures and failing to notify the party chair of the time of pre-processing in sufficient time to have an observer present.
"We were told there weren't going to be votes counted and so if the decision was made to go ahead and count votes, the law required them to notify us that that was going to take place," said Harrison.
According to the State Board of Elections, the general registrar staff assigned follow carefully all the requirements of 24.2-709.1 of the Code of Virginia, including the requirement that at least two officers of election, one representing each party, be present during all hours that the expedited procedures are used.
Harrison is asking that Gibbons ensure at least one officer of election representing each party be present whenever using expedited procedures regarding the process of absentee ballots.
David Neumeyer with the Lynchburg Electoral Board says the board believes the suit is without merit, that she apologized for the two mistakes make this week, and it can't happen again because everything will be finished by the time of Monday afternoon's scheduled hearing.
ABC13 also reached out to both registrars and the State Board of Elections and have not heard back.
So far lawsuits in Roanoke County and Lynchburg. Just the tip of the iceberg IMHO.

Wow, she aplogized so it is ok. Also, according to Neumeyer, since they will be finished cheating by the time of the hearing the complaint is without merit. Seriously. This guy is an idiot in addition to being corrupt. Dems will cheat in every way possible. Civil war folks, civil war.
I live in conservative Pulaski Co. Virginia and they are pretty determined here not to allow any fraud whatsoever. Least that’s what they told me when I called to verify my registration was valid. Should be as I’ve lived here 30 years, but these days you never know!

Also in Virginia and I did the same this year. It never even occurred to me that I should doublecheck my registration status as there's never been a problem. But this year, I wanted to confirm it due to all of the nonsense afoot.
Please tell everybody you know in Pulaski to get out and vote. Rural non-participation has been killing us in VA.
