Over 60 prosecutors, AGs say they will not criminalize abortion if Roe v. Wade overturned

Over 60 local prosecutors and state attorneys general issued a joint statement Wednesday saying that they will not enforce laws criminalizing abortion if the Supreme Court overturns Roe v. Wade, the landmark 1973 decision that first legalized the procedure.

The statement comes amid the Senate confirmation hearings for President Trump's third Supreme Court nominee, Amy Coney Barrett. If Barrett is confirmed the court would have a heavy conservative tilt and Democrats have sounded the alarm that Roe v. Wade could be overturned.

The 63 prosecutors in the joint statement took aim at state laws looking to curtail abortions as well as the prospect that Roe v. Wade may be scrapped altogether in the near future, noting that while they shared different personal opinions on the procedure, they felt curbing access to abortion would criminalize health care decisions.

“As some elected prosecutors have noted, the broad restrictions in the laws passed by these states appear to be unconstitutional under Roe v. Wade. Many of us share those legal views, but our commitment to not prosecute women who obtain abortions and health care professionals who provide treatment is not predicated on these concerns alone – and, indeed, would hold even if the protections of Roe v. Wade were to be eroded or overturned,” they said.

“Not all of us agree on a personal or moral level on the issue of abortion. And not all of us are in states where women's rights are threatened by statutes criminalizing abortion. What brings us together is our view that as prosecutors we should not and will not criminalize healthcare decisions such as these – and we believe it is our obligation as elected prosecutors charged with protecting the health and safety of all members of our community to make our views clear.”

The title is misleading -- prosecutors don't get to decide what is criminalized.

Democrats think judges should make laws and that prosecutors should decide which ones to enforce. Who needs legislators?

You nailed it. Are they invoking holder/lynch’s principle of prosecutorial discretion? I know that’s how they are, how they think; but they’re so wrong.

How about post partum abortion? I suggest we start with these idiot AGs. 10 minutes, 60 years, what’s the difference. If life means nothing it means nothing and a nihilist’s life is especially meaningless.

They can think that all they want. In the end, whether they prosecute it or not, they will answer to The Judge…some day. HE doesn’t overlook things.

The fight wont be over when the SCOTUS rules, it will just now be time for a dialogue to actually happen in politics.

Lib’s don’t want to have that argument because it is a losing argument.

No kidding. All overturning Roe vs. Wade accomplishes is to leave the decision to the states. A few states will outlaw it. Others will subsidize abortion tourism and build combination hotel/abortuary facilities at taxpayer expense.

Abortion was legal in multiple states BEFORE Row v Wade.

If Roe is overturned, we’ll see some states with no restrictions at all and some with tight restrictions (say limiting to 1st or 2nd trimester). But, I don’t see any state outlawing aborting altogether.

Most states will fall in the middle.

The majority of Americans still want abortion to be legal in some form—and it will be.

BTW, this isn’t my position, it’s just the political facts of life at this moment.

They think some black-robed tyrant can magically decide to one day say they don’t like a law, and then strike it down. It doesn’t work that way.

For decades fireworks was outlawed in my state.

There was never a shortage of fireworks. People just drove over to the neighboring states and purchased all they wanted.

But, I’m not seeing any state (even Utah) outlawing abortion.

If Roe is overturned I will possibly collapse with joy. But it will just return the option of child murder to the states. So I will turn my attention there.

We are always fighting to protect children. Always.

Is there a case anywhere in the country right now that could be taken up in the Supreme Court that could threaten to overturn Roe v Wade? I don’t believe there is. So Democrats talking about it nonstop is nothing but rhetoric and fear mongering.

This bs from these whiny snowflake prosecutors is rather like the Portland prosecutors pointing to a building burning while being looted and saying “oh, that’s just legitimate protest, I won’t prosecute”.

We will prosecute a 17 year old kid that was trying desperately to save his own life but if Dr. Northam, Governor of Virginia, decides to kill a baby in a crib (not the womb) because the dumb bitch mother suddenly decided to kill it, no problem. I’m not interested in getting in a shooting match in the street like the 17 year old kid, but if I was this issue would be it.
