Wouldn’t it be nice if Democrats and Republicans could just agree that the fair and right course would be to not replace Justice Ruth Bader Ginsburg until after the presidential inauguration in January? We could simply stick, for now, with the precedent established by Senate Majority Leader Mitch McConnell when he refused to hold a vote on the nomination of Merrick Garland to replace Justice Antonin Scalia.

At the time, nearly nine months before the 2016 presidential election, he declared, “The American people should have a voice in the selection of their next Supreme Court justice. Therefore, this vacancy should not be filled until we have a new president.”

But just hours after the announcement of Ginsburg’s death on Friday, McConnell declared, “President Trump’s nominee will receive a vote on the floor of the United States Senate.”

There is little Democrats can do to stop Trump from nominating someone and the Republicans from confirming that person quickly, if that’s what they choose to do. Republicans hold a 53-47 majority in the Senate, and they have eliminated the use of the filibuster in Supreme Court nominations. So the hope must be that four Republican senators — perhaps those facing tight reelection races — will have the courage to stand up to their party and refuse to allow a confirmation to be rushed through.

That is probably a distant hope. So far, Senate Republicans have shown little inclination to stand up to Trump and McConnell, as was evident in their confirming Brett Kavanaugh for the Supreme Court, despite compelling testimony about an alleged sexual assault and perjury — and despite clear evidence that he lacked judicial temperament. Nor did Republicans demonstrate any independence or courage during the impeachment of Trump.

When Clinton was president, this idiot wrote a book about how the filibuster was unfair.

The filibuster lets the globalists hide their true intentions and hold onto their seats by blaming the lack of progress on the filibuster. Remove it and make the majority take responsibility, right now they have a way to hide and get away with it.

Perhaps you missed the memo, but AA is dead....the blacks killed it.

Race and sex should have nothing to do with this nomination.

This is no sh!t, President Trump will do just fine without hearing from the peanut gallery.

Some day Candice Owens is going to run for high office and I will support her and my support will have nothing to do with the color of her skin, or her vagina. AND, it damn well won’t have anything to do with caring about what some black people want or what some White guilt morons may want.

There are no explicit requirements in the U.S. Constitution for a person to be nominated to become a Supreme Court justice. No age, education, job experience, or citizenship rules exist. In fact, according to the Constitution, a Supreme Court justice does not need to even have a law degree.

Hello! Actually I’m from Michigan. But I lived and worked in Chengdu for 2 years. I would be there now were it not for Covid-19. It’s a very cool city particularly for expats. I know the city wasn’t much back when you were there. What do you remember of it?

It was very primitive. The hotel was probably circa 1900 and very rundown. It was a typical impoverished communist city. My hosts took me on some tours to undistinguished and not noteworthy archeological / cultural sites. I arrived about three weeks after Mao died and the city was in mourning. He didn’t have many statues there compared to Beijing, but everything was covered in white paper streamers. It was probably one of the least memorable places I ever visited. Harbin was #2 on the least memorable place lost.

Guess Chemerinsky is making a big assumption about who/what constitutes the “American people” when he made the statement....“The American people should have a voice in the selection of their next Supreme Court justice. Therefore, this vacancy should not be filled until we have a new president.”.... What would the real American people want in a Supreme Court Justice? I should think they would want one who strictly follows the Constitution as their oath of office compels them to do. If this was done, then one of two things should be happening.....either the ruling thoughts of those following the Constitution would have the majority OR they would ALL be in agreement on issues that hinged on Constitutional interpretation. It’s obvious right now that some Americans are not in agreement with what it says in the Constitution.
