This is a disaster for the Democrats. It is going to suck up all of the media’s energy for weeks - right when they need all hands on deck to attack Trump. Whether a confirmation happens or not, it’s a change of subject they cannot afford right now.
If a replacement is confirmed in a matter of weeks, the Supreme Court will be greatly diminished as an issue on Election Day.
Dems didn’t plan her death very well.
With Ginsburg’s seat vacant, that leaves:
- 4 “known conservative” votes
- 1 “swing vote” (Roberts)
- 3 leftist votes.
Roberts is likely to lean towards the Constitutional position, along with the other conservatives.
Now an 8-member Supreme Court has actually become MORE conservative than it was yesterday.
(I don’t remember where I stole the above but ... stole it I did!) 8-)

This is not workable - this Justice would probably have to recuse.
And besides that, in the practical sense, her seat being left vacant is the same as their being 1 more conservative Justice.
The Circuit Court seats are now filled - any District Court seats than still be filled should be the focus for the remainder of the time.

If the House and Senate disagree on the time of adjournment, the Constitution says that the president may, adjourn them to such Time as he shall think proper.
