But - NEITHER CAN THEY.
Roberts can join the remaining 3 Democrats and split the court...which means they CANNOT overturn a conservative victory from the lower courts.

We don't want another Supreme Court Justice who's okay with an assault weapons ban, and a desire to okay firearms possession for felons is not an acceptable substitute.

The difference here is that the President is a Republican and the Senate is in the control of Republicans. So, the Senate confirms what the President wants. They have every right to do so.
