The Washington D.C. Circuit Court of appeals has ruled 8-2 General Michael Flynn will not have his case dismissed as the Department of Justice has requested and must move forward with yet another hearing.

Abolish the entire D.C. court system. Why is there 10 Judges on one circuit court in a town that is not even a state.

IMO just a face saving measure so that Sullivan can dismiss the case. According to the decision, Sullivan must proceed with the appropriate dispatch.
Please explain what happens after Sullivan sentences him to prison? Who is going to take him to prison and what prison are they going to take him to since the DOJ has no further involvement in prosecuting him?
Other judges allowing Sullivan to drop the case

1) Flynn is a former Democrat gone apostate on them.
2) Flynn opposed Obama’s deal with Iran, and threatened its continuation.
3) Flynn opposed Obama’s creation of ISIS and Obama’s pretense to be combating Islamic extremists in Syria.
4) Flynn utterly trashed Hillary Clinton in his speech at the 2016 Republican Convention (look that one up).
5) Flynn let it be known he was going to “audit” intel agencies, and root out corruption, redundant effort, and waste in general. This threatens the swamp’s gravy train and diversion of federal funds into politics.
6) Flynn was an experienced military intel and national security player. The Dem’s wanted to deny Trump any credible personnel so he would be dependent on the career swampers and a handful of advisors like Page, Popadopolous, et al., the Dems could make fun of (No offense to them, but they aren’t even third tier experts).
7) There are probably more, but the above is a good starter set.

If Biden wins, he’d nominate Sullivan to the Supreme Court no doubt.
Barr/Durham need to come out with both barrels and demonstrate how all this was part of a soft coup against the American people. Every bit of this began because of the fake Russia narrative.
In addition, if Sullivan gives Flynn even a 1 minute suspended sentence, the Dems/media will crow that it proves Flynn was guilty and the Barr DoJ was trying to let a guilty man escape justice.

The DOJ has dropped the case and asked that it be dismissed.
There is no prosecution, there is no case.
Sullivan can do one of two things:
1. Deny the motion to dismiss and sentence Flynn on the guilty plea that is still in play, in which case he will look like an utter fool because the verdict and sentence will be vacated on appeal. GUARANTEED.
or,
2. He can grant the motion to dismiss the case, in which case he will look like a fool for trying to have the hearing and not ruling on the case earlier.
Why should Trump pardon him? He is innocent. And has not been sentenced to any prison time because the case is still pending.
He is NOT under a gag order, per Sydney Powell.

The obvious answer is because he is exceedingly and conservatively effective.
