Did St. Louis Couple Bluff Trespassers with Inoperable Guns? Why it Matters

The pistol brandished on the McCloskey property in St. Louis appears to have been identified.

The ongoing saga of the McCloskey couple in St. Louis, and their ability to defend their home against a mob of hundreds of people who invaded their private, gated community, has taken some interesting turns.

It has been reported the radical St. Louis Circuit Attorney, Kim Gardner, has charged the couple with unlawful use of a weapon. Missouri has such a statute, as written about earlier on Ammoland.

The charge is controversial. Missouri has a very strong Castle Doctrine law, which gives considerable leeway, especially when people are on their private property.

When the use or threatened use of force is claimed to be justified, as Mark McCloskey has claimed, the state has to burden of proof to show that the McCloskeys' fear for their lives and property was unreasonable. It is a difficult burden for the prosecution to overcome, especially when confronted with evidence of an angry mob of hundreds of people.

Another controversy has developed. The police seized a pistol, which was said to be the one handled by Patricia McCloskey during the incident.

In a program on St. Louis Public radio, the claim was made that prosecutors had to prove the weapons used by the McCloskeys were capable of lethal force. From stlpublicradio.org:

In order to issue the charges, prosecutors must prove the guns were capable of lethal force.

In a close up of the weapon seized, it appears to be a Bryco 38, an inexpensive weapon which has been embroiled in considerable controversy.

I disagree completely with them trying to weasel out of this in any way, shape or form.

Take this head on, stand firm, the governor has already said he would pardon them so they really have nothing to lose.

Don’t let them win this by the left’s own usual back-door methods, win it on the Constitutional right, straight up, period.

It is my understanding that the charges have not yet been dropped.

The AG has joined the case and is requesting that the court drop the charges, but as of yet, the court has not done so.

“Old news and the charges have been dropped.”

Isn’t it a bad idea to brandish “firearms” which won’t fire?

Old news and the charges have been dropped.

I do not believe the charges have been dropped.

There was a false report the charges had been dropped, based on the call by the Missouri AG, about 10 days ago, calling for the charges to be dropped.

From the article: It has been reported, the police did not find any ammunition for the rifle Mark McCloskey possessed at the time of the incident. So, an inoperable pistol and a rifle with no ammo. If the ammo report is true, they you have to really hand it to the McCloskeys. Brave people pulling off a bluff like that.

Not knowing his wife, I can't truly say, but it is kinda funny that the only weapon he gave her was one which he knew posed no danger to himself. a.. "I see what you did there" moment.

The joke on those has been that the magazine should come loaded and unable to be removed.
By the time it has been emptied the pistol is worn out.
Strange weapon for a wealthy lawyer to have.

It was a prop for a legal case. Why spend more than you have to.

But, then why wouldn’t an air soft pistol have worked?

Oh yea, they cost about the same. LOL

“...win it on the constitutional right....”

And go broke from legal fees. There is no justice anymore. Just too dang expensive for most people unless you’ve got help.

The reason they had an inoperable pistol was that they had used it as a prop in a court case. To disable it, they has put the striker in backwards or some such. They must only have the one good gun, and the wife grabbed the prop.

Perhaps a good way to handle these situations is to use fake or inoperable weapons as a fist means to scare these SOBs, while having fully operable weapons just feet away and within quick retrieval, but out of view.

What does that mean, “appears to be identified”. It was in police custody, we knew exactly what it was. We also knew that the McClosky’s were involved in a court case involving that very gun, and had disabled the gun to take it to court, and it was still disabled.

I have read nothing to suggest that the rifle was disabled.

Same thing with Michael Flynn.

The bastards never drop the charges. If you’re a law-abiding, tax-paying citizen, their strategy is to force you into bankruptcy through attorney fees.

I doubt that would buy you much in court. Staging the real weapons nearby would indicate premeditation.

It was reported several places yesterday. You could google it if you need to see it for yourself.
