O R D E R
Upon consideration of the petition for rehearing en banc, the responses thereto, and the vote in favor of rehearing en banc by a majority of the judges eligible to participate, it is ORDERED that this case be reheard by the court sitting en banc.
It is FURTHER ORDERED that the court’s order filed June 24, 2020, be vacated.
It is FURTHER ORDERED that oral argument before the en banc court be heard at 9:30a.m. on Tuesday, August 11, 2020.
The parties should be prepared to address whether there are “no other adequate means to attain the relief” desired. Cheney v. U.S. Dist. Court for D.C., 542 U.S. 367, 380 (2004).
A separate order will issue regarding the allocation of oral argument time.

This is in no way a suprise. The Panel’s decision was an embarassment and playing politics for attention.
Prediction: In this decade we will see the end of the abomination which is life long judicial appointments.

Man, I’m so discouraged.
Practically every judge is a political hack.
It’s time for Trump to issue a pardon.
Dare I ask if Flynn can appeal this idiocy to the USSC? Or must he first endure the full appeals hearing?
Pardoned for what? I thought he had to be convicted and sentenced first.
Even if the President does issue a pardon, which cannot be guaranteed, that does not keep Flynn from a lengthy prison term. The judge still can sentence Flynn. The pardon, if not vacated or overturned, just means that Flynn will emerge from prison (if he survives his sentence) as a free man without the debility of a felony conviction. In other words, he then can vote, but probably only for certified Communists as no other options then will exist. The Democrats quite possibly will initiate a constitutional amendment, requiring the Party to certify and approve all pardons. Or perhaps such an amendment has already been ratified secretly like the repeal of large parts of the former Bill of Rights, as several governors publicly confirmed.
Adequate means.....here would be the matter goes back to Sullivan for a ruling after you wade through his elongated hearing process. Then the ruling can be appealed, in regular order.
In other words, this will take at least, at least, 3-4 months, with a possibility of not ending until after inauguration day, by which time the DOJ may be run by ......?????
I can now see a path for Flynn to go to prison, although if the Dems win November Trump would hopefully pardon.
