Judge orders government to explain 'scope' of Roger Stone commutation (Berman)

A federal judge on Monday ordered the government to explain the “scope” of President Trump’s commutation of longtime GOP operative Roger Stone, including whether the move only involved the sentence of incarceration, or also the period of supervised release.

U.S. District Judge Amy Berman Jackson ordered the government to provide the court by Tuesday, July 14, “a copy of the Executive Order commuting the defendant’s sentence and to address the question of the scope of the commutation, in particular, whether it involves the sentence of incarceration alone or also the period of supervised release.”

In February, Jackson sentenced Stone to 40 months in prison, along with 24 months of supervised release and a $20,000 fine.

The filing, signed by Jackson, comes after the White House announced Friday that the president signed an Executive Grant of Clemency commuting what they called the “unjust sentence” of Stone, just days before the longtime political operative was slated to report to prison to serve more than three years for charges stemming from former Special Counsel Robert Mueller’s investigation.

Stone was set to report to prison on July 14 to serve 40 months. He was sentenced in February to more than three years in prison after being convicted in November 2019 on seven counts of obstruction, witness tampering and making false statements to Congress. Stone, however, has appealed his conviction and continues to deny any wrongdoing.

My understanding is in Federal cases the presidents authority to pardon or commute is absolute.

The seditionists are getting bold in the district court of the District of Columbia.

We've got Dirty Emmet flipping off the DOJ and the DC Circuit Court of Appeals.

Then district "judge" Tanya Chutkan flips off a Federal Circuit Court of Appeals [the Seventh Circuit].

Now we have Amy Berman Freisler, Nazi hanging judge for ClownBammy, challenging the commutation power of the President of the United States.

They'd look good in a nice line like the Booth conspirators...

That would get her out of the picture, but since Stone is still appealing his conviction, wouldn't it be better to let that go forward. The prosecution as well as the judge's handling of the case needs to be reviewed by the higher courts.

I wondered about this but another story from CNN argued that NY should prosecute Stone since they recently passed a law that allowed NY to prosecute under state any one “pardoned” by a President who might have information on a President. Maybe by commuting the sentence, PDJT is sparing Stone a hassle from NY.

I remember the woman who is now the NY Attorney General campaigning on the platform of going after Trump and his family.

That’s exactly what she’s doing. Pulling a bureaucratic stunt to try to throw a wrench into the clear purpose of the commutation.

Splitting hairs so she can start an argument over details, kick the can down the road, somehow recover the scam she ran.

Think she’d do this if the commutation was to Cletus T. Bankrobber, hard luck story of the week?

If,by chance,the President erred in the wording of the commutation and,as a result,Stone's still required to report to some BOP official periodically the Swamp Creatures will try to trap him on some technicality and,having done so,put him behind bars.

Since a co-worker's BIL died of covid at 71, I wouldn't be too snarky about Stone going to prison not being a death sentence since it's been wildly stated he has several health issues and many prisoners are getting early release because covid.

There are lots of people who don't even make it to 71 even in the 21st century.

If there was a technically, say probation wasn’t included in the original commutation order, couldn’t Trump just issue another commutation for that?
