Baca was overruled by SCOTUS (well, RFDed with instructions to follow the new precedent. And the Baca circuit majority was full of shi’ite when it claimed that prior SCOTUS precedent clearly held that states could not interfere with presidential electors’ votes.
BTW, I agree with the SCOTUS decision that states can punish faithless electors and even replace electors wo do not vote as they had pledged to vote.
I agree with the Baca decision and Thomas’s opinion in Chiafalo. State can enforce law to replace electors.
I don’t agree on fines and criminal charges. For political behavior.
