On Monday, President Trump threatened to deploy the United States military to American cities to quell a rise of violent protests, but Seattle Mayor Jenny Durkan says that’s unconstitutional and illegal.
Trump said he would mobilize “thousands and thousands” of soldiers to keep the peace if governors did not use the National Guard to shut down the protests
Durkan tweeted a long statement shortly after the president’s promise:
"The president’s threat to force U.S. military troops on local jurisdictions is unconstitutional and illegal, and shows a shocking lack of understanding about the use and work of our U.S. military.
The Posse Comitatus Act specifically prohibits this type of executive overreach and the mobilization of the military against the American public.
We are a nation of laws and fundamental constitutional guarantees, and one of the most important is the right of every American to assemble, peacefully protest, and to free speech which is what we have overwhelmingly seen across the country.
We welcomed the National Guard over the weekend who have helped in unarmed duties with support and logistics as we deal with the effects of civil unrest and the bad actions of a few. But let me be clear: no U.S. Military troops are needed nor will they act as police in Seattle."

“The Insurrection Act
The Insurrection Act of 1807 is a United States federal law (10 U.S.C. §§ 251–255)[1] (until 2016, found at 10 US Code, Chapter 15, §§ 331–335, renumbered to 10 USC, Chapter 13, §§ 251–255) that governs the ability of the President of the United States to deploy military troops within the United States to put down lawlessness, insurrection, and rebellion. The general purpose is to limit presidential power, relying on state and local governments for initial response in the event of insurrection. Coupled with the Posse Comitatus Act, presidential powers for federal military law enforcement on U.S. soil and unincorporated territories are limited and delayed.
(1) The President may employ the armed forces, including the National Guard in Federal service, to–
(A) restore public order and enforce the laws of the United States when, as a result of a natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition in any State or possession of the United States, the President determines that–
(i) domestic violence has occurred to such an extent that the constituted authorities of the State or possession are incapable of maintaining public order; and
(ii) such violence results in a condition described in paragraph (2); or
(B) suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy if such insurrection, violation, combination, or conspiracy results in a condition described in paragraph (2).
(2) A condition described in this paragraph is a condition that–
(A) so hinders the execution of the laws of a State or possession, as applicable, and of the United States within that State or possession, that any part or class of its people is deprived of a right, privilege, immunity, or protection named in the Constitution and secured by law, and the constituted authorities of that State or possession are unable, fail, or refuse to protect that right, privilege, or immunity, or to give that protection; or
(B) opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws. “

Yes, but federal occupation comes in when state/local authorities have totally lost control. Which is increasingly the case in most deep blue states/cities.

Had 1st taste ever of protests in my small city yesterday....our Veterans (conceal carry and otherwise) were invited to volunteer and did to protect our monuments.....store owners too.
People were arrested immediately if throwing anythng , or fighting between themselves. 8 arrests in a crowd of 300-400, and the crowd was dispersed in one hour once the violence began.
So proud of our officers show of force and preparation to take things in hand from the get go.
Those fresh out of the Sandbox would handle tactical duty, and old Vietnam Era farts like myself would hold down a desk to free up someone else for tactical duty.

Few things more satisfying than a 90mm recoilless with an APERS round!! Used to have lots of flechettes from those in my ruck. Shooting those was the only reward for humping them through the woods.
Durkan is also a former U.S. Attorney for Western Washington who refused to prosecute corruption by previous governors, StateAgs and members of the Washington State Supreme Court.
