Judge Napolitano: Trump has no authority to override church bans, but can do this (hint, hint)

Fox News senior judicial analyst Judge Andrew Napolitano said Friday that President Trump does not have the authority he says he does when it comes to overriding governors who will not allow churches or synagogues to reopen.

However, Napolitano told "The Daily Briefing" that the governors' bans are "ill-advised" and that the president does have one major recourse should a state executive fail to listen to his orders.

"In a word, no," he said of Trump's authority on the matter.

Right. He just dropped a nuke on them - he made it ‘leftists vs. the Church’. We both know they’re too full of hate for the Church and PDJT to let it go. They can’t help themselves.

I thought the D’s had already destroyed their party. I suppose they were just getting started.

I seem to recall that the President tasked the Justice Department to look at Governor’s actions, to protect civil liberties from unconstitutional over reach, a couple of weeks ago.

My guess is that this was identified during that process, and the Administration has already gamed out how it will play out, before springing it on the Lefty Governors to react.

In other words, its likely a prepared trap.

They reflexively do the opposite of whatever Trump proposes. Too easy.

Wow, great image but the fact is, the churches are finally fighting back. Bishops are opening up their churches and are the governors really going to fight an archbishop? Those guys have lots of powers. Right up there with judges.

Right. I think this is going to be a theme over the next few weeks: Trump demanding that governors open one thing after another.

And, as you say, he will do it in a way that challenges their authority, in order to box them in. Either they “obey” his order, or they go on record as being against what the people desperately want.

I just hope he includes bar/restaurants and diners soon. Going to a bar isn’t just about being able to drink alcohol - you can already do that at home. The local pubs, taverns and diners are important gathering places and are symbolic of our freedom to gather and assemble and make public discourse.

And regardless of how people rank such services as tattoo parlors, bars, music and entertainment venues, etc., regarding how “essential” they are - these industries employ millions of people, and their livelihood is just as important as anyone else’s.

The government deciding who is essential and who is not - may just be the most disturbing aspect of this whole fear-based government crack-down. They shouldn’t be able to decide who is “essential” any more than they should be able to decide what speech is allowed, or what weapons we can own.

Doesn’t Trump swear to uphold the 1st Amendment freedom to worship?

Where does it say this amendment gets turned off because governors say so?

That’s one of my issues with state gun control measures.

If states can’t turn off and on civil rights related to race,
they can’t turn on and off our 2nd Amendment rights.

If they did the people would easily be deprived of many constitutionally guaranteed/protected rights.

To saythe president can’t enforce and protect constitutionally guaranteed rights from governors is absurd and destroys federal laws and power.

I am for states rights but states rights don’t exist to create dictatorial governors that think they can take away guaranteed rights at tge federal level.

I don’t think Trump can do this, but, it will be into his third term before the SC rules. Until then, I don’t think the blue govs will have anything to spend.

Hey Judge, would you please tell me where “nor prohibit the free exercise thereof” and “right of the people to peaceably assemble” were nullified and/or governors given the power to ignore the first amendment.

The judge is correct.

The closures are done through the extensive police power of States.

There is no Federal police power.

Back in the 50s, we did that a couple of times to some nasty people in an adjacent neighborhood. It was fun to watch from the bushes across the street. LOL.

LOL! I am still trying to figure out if this is inartful or astute as hell. Whatever, it is amazing that he still has them falling for it. We've really got him this time.

Trump is sworn to enforce the Constitution, which includes that religion cannot be stopped from exercise.
