A total of 15 Republican state attorneys general, led by Ohio Attorney General Dave Yost, filed an "amicus" brief in support of former national security adviser Michael Flynn on Monday, Fox News has learned.
The filing stated that the court needed to grant the DOJs motion to dismiss the case without commentary immediately because such punditry disrobes the judiciary of its cloak of impartiality. The short brief also elaborated on the problems that the court created by inserting itself into the Justice Departments exercise of prosecutorial discretion.
On the recommendation of U.S. Attorney Jeff Jensen, who served as an FBI agent for more than a decade, the Justice Department earlier this month moved to drop its case against Flynn. The stunning development came after internal memos were released raising serious questions about the nature of the investigation that led to Flynns late 2017 guilty plea of lying to the FBI as his legal fees mounted.
One of the documents -- apparently concealed for more than two years in defiance of a court order -- was a top official's handwritten memo debating whether the FBI's "goal" was "to get him to lie, so we can prosecute him or get him fired." Other materials showed efforts by anti-Trump FBI agent Peter Strzok to pursue Flynn on increasingly flimsy legal grounds.

Why doesn’t Sidney Powell file to overturn Sullivan immediately? All they want to do is keep Flynn quiet. They are accomplishing that goal.

I think she has already filed.
DoJ should just file an appeal to overrule Judge Sullivan - saving the Flynn team the expense.. I think it was Mark Levin that ID'd the type of appeal. IMHO Sullivan is trying to force POTUS to pardon Flynn thus denying the General any chance of ever claiming innocence.

Flynn plead guilty in Sullivan’s court. Now Sullivan wants Flynn charged with perjury. Sullivan isn’t just on thin ice with this strategy. This argument is dead in the water.
Court pleas are not testimony about facts in a case. They are based on many things including the details and strategies of the case against a defendant.
This whole thing would be over if the DOJ would just go to the circuit court and get a writ of mandamus then drop the charges and reassign the case to another judge. I don’t understand why they are not doing it.

Great news. I hope treasonous Sullivan will accept the brief from them as they won’t exactly be “amici” of HIS court. Can he reject receiving it?
It is the DOJ’s motion, not Flynn’s.
