Oregon judge halts statewide coronavirus restrictions

An Oregon judge on Monday halted statewide coronavirus restrictions, ruling in favor of churches and congregants who challenged the measures as an unlawful infringement on their religious freedoms.

Circuit Judge Matthew Shirtcliff's ruling temporarily suspends all of Gov. Kate Brown's (D) emergency coronavirus measures, not just those applying to religious gatherings.

Brown vowed to immediately appeal to the Oregon Supreme Court.

In lifting the restrictions, Shirtcliff said the church groups challenging the orders were likely to win a final ruling on the merits. Their initial showing persuaded him that the health orders’ harms to religious and economic freedom outweigh public safety.

“The public interest is furthered by allowing people to fully exercise their right to worship and conduct their business,” Shirtcliff wrote. “Additionally, the utilization of social distancing protocols without additional restrictions is in the public interest to restore individual liberties and the ability to restore economic viability in our communities.”

Brown fired back on Twitter, calling it “irresponsible to dismiss the health risks and science behind our measures.”

“The science behind my executive orders hasn’t changed: today’s ruling from the Baker County Circuit Court will be appealed to the Oregon Supreme Court within hours to keep my emergency orders in effect, ensuring we can continue to safeguard the health of all Oregonians,” she said.

Seeing as the governor did not issue her edicts in 14 day increments, she is still in violation.

And even though that section doesn’t mention legislative approval, the other emergency statute she cites in her orders does, as does the 10A clause of the state constitution.

Brown does not get to pick and choose which sections of the statutes and constitution she follows. She could have actually bothered to conform to the law, just like she expects us to conform to her edicts.

She’s a scofflaw.

See #37.

Is anyone in the legislature calling her out on it?

the statute appears vague on the 28 day limit. Any vaguery will go to the guv in the state supreme court.

I wonder if the OR legislature has interceded..,? They have not. They have not been in session since the emergency began.

The Governor has been having a very hard time with the legislature. The Dems have a sizable majority, so the GOP has taken to boycotting as a group to prevent quorum.

“O.K., first we (the people) win in Wisconsin. Now we win in Oregon.”

Now we need a judge up here in WA to kick Inslee’s butt too.

Frankly, I have no doubt the OSSC will twist themselves into pretzels to find for Kate. They are perfectly happy to ignore the statutes and the constitution.

“Seeing as the governor did not issue her edicts in 14 day increments, she is still in violation.”

If she did not, she is in violation and the court will find with the original judge.

That part is clear.

You have said a repeatedly on this thread that the statue is vague. I don't find it to be at all vague, and neither did the judge. Here's what it says:

433.441 Proclamation of public health emergency.
(5) A proclamation of a state of public health emergency expires when terminated by a declaration of the Governor or no more than 14 days after the date the public health emergency is proclaimed unless the Governor expressly extends the proclamation for an additional 14-day period.

If I tell you that you may have a cookie, and if you are still hungry after you have one, that you may then have "an additional cookie" - can you eat the whole bag?

Or, are you referring to some other part of the code?

Did you read the judges ruling?

.preparing us for the rat infestation....

Well in Oregon they already control both houses, the Governor's office and almost every State level office. We won the Secretary of State a while back, but that's targeted now, too.

Sadly, the Oregon Supreme court just stayed the lower court judges ruling pending hearing
