The Justice Department’s move to dismiss the prosecution of former national security adviser Michael Flynn does not need to be the end of the case — and it shouldn’t be. The Justice Department has made conflicting statements to the federal judge overseeing the case, Emmet G. Sullivan. He has the authority, the tools and the obligation to assess the credibility of the department’s stated reasons for abruptly reversing course.

The department’s motion to dismiss the Flynn case is actually just a request — one that requires “leave of the court” before it is effective. The executive branch has unreviewable authority to decide whether to prosecute a case. But once it secures an indictment, the proceedings necessarily involve the judicial branch. And the law provides that the court — not the executive branch — decides whether an indictment may be dismissed. The responsible exercise of that authority is particularly important here, where a defendant’s plea of guilty has already been accepted. Government motions to dismiss at this stage are virtually unheard of...

If I were Trump, I would call Flynn and tell him not to worry about any of it, because if the judge won’t dismiss, Trump will pardon him.

It's looking like quite the mess, now.

The Clintonoids and Obama-ites have control of the DC Circuit Court of Appeals right now, so we know how an appeal to them will go.

T don’t think he cares anymore and is inviting impeachment now. But he’s” black” so it’ll never happen

the Dems won’t advance him - he’s too old -and no rational administration will advance him because he’s nuts/..

Saying again... this used to be a good judge.

He was able to keep up the appearance of "a good judge".

If you couple this Flynn business with his actions on the Ted Stevens mess, it's come clear that he has always worked for the DNC.

His part in the Stevens imbroglio was to deliver the 60th vote for Obamacare, and he delivered in spades.

That’s exactly what the democrats are hoping Trump does. They’ll use it to start another impeachment investigation and they will be slinging mud at him for it right up to the election, if there is an election.

That’s the problem, the deepstate WANTS trump to pardon Flynn instead of exoneration. Easier to continue the political play that Trump/Barr made corrupt political moves to get Flynn off. By the way, Gleenson firm represented Sally Yates recently and he’s a mentor of Weissman of sorts. They are all connected

Hannity just had a guest on who said BS to this judge. DC circuit just settled a case two years ago, very similar - judge has to acquit - he has no choice - I didn’t catch the catch the case name.

No judge will ever be impeached for a politically charged decision no matter how egregious until the county becomes so one-sided politically (read: communist) that they become routine.

We’re basically already in a civil war. There is no commonality between the two sides and no law and order. GOP is trying to restore it, but it’s a lost cause. Everyone is just exhausting every nonviolent option until the bullets start flying.

So the Judicial Branch is now giving itself the Executive Branch power to prosecute?

Who needs the US Constitution and separation of powers.

Perhaps the DOJ can hire its own judge and dismiss the case.

The Deep Statists are trying to force Trump into doing that when there is no reason for doing it. A pardon would be seen as validating the prosecution, plea, and conviction of Flynn. A dismissal opens the floodgates for more retroactive dismissals of the Mueller defendants. Demonstrate that even one defendant was illegally railroaded by Mueller’s Conga Line of Criminally Inclined Prosecutors and ALL of the Mueller Prosecutors’ work product, the other indictments, prosecutions, and convictions, even the Mueller Report, start falling like a house of rotten cards assembled on quicksand.

That’s exactly what the Dems want to happen, to force Prez Trump to have to pardon Flynn, thus implying he was guilty of something that needed pardoning, rather than having the case dismissed and thus Flynn deemed innocent up front.

There has to be another avenue on appeal to make this Clinton judge stand aside and to dismiss this case. I’m sure many conservative lawyers’ heads are knocking together this very minute on how best to approach this case in order to get rid of this corruptly politicized Judge and get the case dismissed ASAP.
