My understanding is that the judge can accept the original guilty plea and sentence Flynn.

I'm no lawyer, but isn't there a bit of habeas corpus here? Flynn pled guilty -- but to what? Was there a real crime? DOJ says No. Flynn is making a claim, but someone needs to prove that the claim is true -- did an illegal act take place?

You know, if I claim I murdered Brad Pitt, they won't convict me. Sure, I pled guilty. But there was no crime.

You stated in open court that you killed Brad Pitt, that's perjury.

What if they waterboarded you first, and got you to confess? And then said, "Oops, he confessed under torture, we have exculpatory evidence. Sorry for the mistake?"

For Flynn the torture was legal and financial, and he was basically forced to withdraw from public life to save his son from a clearly vindictive prosecution after spending his life savings. Does his "confession" have weight or was it coerced?
