Half Whit in did this in Mi yesterday when the court ruled she cannot stop a barber from opening in one of the small towns in Michigan she pulled their license illegally without a hearing the day after the court ruling.

I definitely see a place for these emergency orders, like we see with the president having power to Take military action for certain period of time before Getting congressional approval to continue in times where seconds or minutes count. Same as it should be applied to the state governors, in the early days of the pandemic they need to make quick decisions, but those should be limited to say 14 days before they must get legislative approval of their plans. That should also require additional legislative approval of any changes or to extend The orders every 14 days as well. That way they all need to justify their actions.
In virginia, we have a law, the law grants powers to the executive when there is a state of emergency. The governor is allowed to declare a state of emergency, on a pretty broad basis (in January, he declared a “state of emergency” because of a political rally, and courts upheld his right to do so, and to curtail 1st and 2nd amendment rights based on the emergency).
I’m guessing the law has some method for the legislature to step in. It appears that our law does not have a time limit.
We the people do have the right to recall our governor, and that seems to be about the only thing we could do right now to legally stop him from doing anything he wants, with the power of our SOE law.
