I’ve seen asbestos abatement workers cut a hole in their respirator for a cigarette. Honestly. Or put a rag with solvent on it inside their respirator to get high.

“I don’t understand why the feds don’t put an end to the trampling of the peoples constitutional rights!?”

Barr expressed a fleeting concern a couple of weeks ago. Went nowhere.

Licensing is just a ploy by established persons (think florists) to keep the competition out. Also gives the states a platform to regulate and tax. I hold a number of licenses in Texas. Makes jobs for bureaucrats

Instead they will threaten to pull business licenses, which is what Tom Wolf is doing in PA. “

Half Whit in did this in Mi yesterday when the court ruled she cannot stop a barber from opening in one of the small towns in Michigan she pulled their license illegally without a hearing the day after the court ruling.

Miracle - this looked really bad a few days ago. Evers and Palm are not done yet. They will hit this from another angle.

“The bars are open tonight in Wisconsin”

And I hope the barber shops are open tomorrow so I can cross the border from The Peoples Republic of Illinois to get a haircut.

I definitely see a place for these emergency orders, like we see with the president having power to Take military action for certain period of time before Getting congressional approval to continue in times where seconds or minutes count. Same as it should be applied to the state governors, in the early days of the pandemic they need to make quick decisions, but those should be limited to say 14 days before they must get legislative approval of their plans. That should also require additional legislative approval of any changes or to extend The orders every 14 days as well. That way they all need to justify their actions.

But it did boil down to a separation of powers argument, as expected.

That's the easy one to make. Locking people up or issuing fines because "the governor said so" is a a more obvious display of tyranny. Any would be co-conspirators with these governors ought to be forced to formally sign on, so they can be held accountable.

In virginia, we have a law, the law grants powers to the executive when there is a state of emergency. The governor is allowed to declare a state of emergency, on a pretty broad basis (in January, he declared a “state of emergency” because of a political rally, and courts upheld his right to do so, and to curtail 1st and 2nd amendment rights based on the emergency).

I’m guessing the law has some method for the legislature to step in. It appears that our law does not have a time limit.

We the people do have the right to recall our governor, and that seems to be about the only thing we could do right now to legally stop him from doing anything he wants, with the power of our SOE law.
