Mr. “DA,” you know perfectly well that the McMichaels had no legal justification to brandish weapons in the first place.
I’m not the DA. I only studied the law but never went for the bar. I entered another field. The ADA was the other guy.
Georgia has a statute allowing people to detain criminals.
As far as brandishing, note the words “without legal justification”:

“A person is guilty of a misdemeanor when he intentionally and without legal justification points or aims a gun or pistol at another, whether the gun or pistol is loaded or unloaded.”
