Holy shit. The felony murder charges mean that a victim was killed during the commission of an underlying felony, in this case aggravated assault. The charge doesn’t require intent to kill.

No you can’t go after a guy with a shotgun and then have to kill him in “self defense”. Don’t go after people with guns it’s ridiculous and it’s not safe gun handling. In your house is one thing. Out on the street in pursuit is another.

Depends on the state. Here in PA we have the 'castle doctrine' which means, that I have the same 'at home protection rights' no matter where I am.

If my neighbor's house is being robbed, and I am walking my dawg {which I do twice a day, and always armed}, and I see the perp running from the house and I confront and then shoot him dead, {because I fear for my own life} then I say to the police, "I feared for my life, and I want my lawyer".

In PA, I win, in GA I don't know what the law is.

Any non-felon in PA can open carry, and any non-felon in PA can get a concealed permit with almost no hassle and only a $20 fee {good for 5 years}.

Great state for patriots regarding the 2nd Amendment.

I’m not the DA. I only studied the law but never went for the bar. I entered another field. The ADA was the other guy.

Georgia has a statute allowing people to detain criminals.

As far as brandishing, note the words “without legal justification”:
O.C.G.A. 16-11-102 (2010)
“A person is guilty of a misdemeanor when he intentionally and without legal justification points or aims a gun or pistol at another, whether the gun or pistol is loaded or unloaded.”

Were they in fear of death or severe bodily harm when the were chasing down the perp with the father in the bed of a pickup truck waiving a revolver? (The weapon was not holstered, it was in hand.)

No. Therefore they had no legal justification to brandish their weapons.

Ok that makes sense. But when ive seen surveillance camera footage attempting space saving, it has been with like every other frame missing or something like that. I forget what it’s called.

But it makes some sense to speed it up instead I guess...
Except for it makes it terribly difficult to make I.d With sped up footage. And isn’t that what surveillance footage is for? I’m anything close to an expert on surveillance cams though.

You’re quibbling because they didn’t know if his trespassing amounted to burglary. Well, under Georgia law, entering a dwelling, even if vacant, is burglary.

O.C.G.A. 17-4-60 (2010)
17-4-60. Grounds for arrest

A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge. If the offense is a felony and the offender is escaping or attempting to escape, a private person may arrest him upon reasonable and probable grounds of suspicion.

GA Code § 16-7-1 (2014)

(b) A person commits the offense of burglary in the first degree when, without authority and with the intent to commit a felony or theft therein, he or she enters or remains within an occupied, unoccupied, or vacant dwelling house of another or any building, vehicle, railroad car, watercraft, aircraft, or other such structure designed for use as the dwelling of another. A person who commits the offense of burglary in the first degree shall be guilty of a felony

Also you say the son “leveled” the shotgun at AA. Please show proof. Otherwise you just literally made up your own facts.

And what do you define as excessive force? Dont say shooting him because that wasn’t done until after he attacked.

Seems you have trouble with basic vocabulary and definitions.

“At most” tresspassing? When their is AMPLE evidence of burglary?

I never saw him point or aim the gun at the perp.

And I can just almost guarantee you this...if he HAD been pointing the gun at AA, then he would’ve shot him in the chest before he even had a chance to grab the gun after seeing him charging towards him.

So now all cops are to presume anyone leaving a privately-owned property is a criminal? How does the cop know the jogger doesn’t have permission to be there?
I’m curious how you would react to being stopped by the police every time you left your house. It’s too bad the jogger isn’t alive to sue those two jerks for violating his rights.

So you’re suggesting the decedent while on his jog, entered a private home under construction not to see if there was anything to steal, but was simply curious what colors they chose for the kitchen? Not happy with the colors, he ran out of the residence like he was on fire. Got it!

No silly. He was getting ideas for his future habitat for humanity work he would've been involved in had hr not been gunned down for his skin color. 🙄 Gah! Why do you people always assume someone who is on someone else's property illegally, after it had recently been burglarized along with other crimes committed in the neighborhood, are up to know good? Regular ole innocent people always walk up into other people's houses and case the joint a few minutes and bolt like their butt is on fire when they see someone watching them obviously calling the cops. Totally normal. Don't believe me? Look at the responses to the video on twitter. "I do this all the time" defenders are saying. Heck even some freepers say the same thing.

Btw slick, looking a bit closer, at this construction site video, you can see a very expensive tool, in fact what appears to be a mini motorized materiel handler of some sort at the lower left of the video.
