So is this better/worse than if Judge Sullivan had made the ruling?
I think that there should be a huge apology before this, one long and drawn out...
Flynn might have been better equipped to pursue a civil lawsuit if the judge had ruled in his favor on the matter.
I think issue is Flynn pleaded guilty earlier so the best outcome was for the DOJ to drop all charges.
Much better because (a) Sullivan cannot be safety predicted to dump it, only to ‘maybe’ allow withdrawal of guilty plea, and (b) much wrangling, appeals and delay would occur without nolle prosequi (DOJ’s decision to no longer prosecute).
Worse, now the media will spin it as politically motivated.
I don’t know if it is better or worse, but basically, this is DOJ stepping in and kicking Team Mueller in the nuts. The motion admits the FBI had no case, and once the Mueller team was gone, the DOJ team tenders a motion that is 180 degrees opposite Team Mueller.
This is a hell of an opening move.
Would have been better justice if Sullivan dismissed with prejudice. That way the prosecutors could be more readily indicted, as opposed to merely sued.
I’m hoping that this will allow other cards to fall that were waiting on the disposal of this case.
A: Better:
B. Worse:
Than if the judge threw the whole case out next week, and read the riot act at the police and sanction the prosecutors.
I suspect this happened because option B was looking more and more likely to occur. I say worse because there will be many Leftists saying "well, Trump just let him off" as things now stand.
