You are apparently trying to write 18 U.S.C. 242. (Those three letters are important.)
The death penalty is only an option IF “death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.”
So which of those occurred here?

The story seems to imply that being a Democrat should have been a disqualifier. Not so. Neither side can stack the jury in its own favor.
The standard question “are you able to disregard your personal opinions?” is deemed sufficient.
Not only would *overt* expressions of unwillingness to put biases aside have been instant disqualifiers, but additionally, attorneys each have the right to 6 preemptory strikes, without giving a reason.

Just when ya think our judicial system can’t get any more corrupt, then details of the Stone trial get revealed. This is down right depressing.
So a reversal on appeal is likely but Trump should just pardon Stone.
If the court records show as claimed that Judge Berman had her finger on the scales of justice during voir dire, this will be overturned on appeal, at which point, now that all the original prosecutors have resigned, the DOJ is likely to choose to not retry the case and drop the whole mess into the cistern of history.
No pardon is necessary unless the DOJ decides to retry.
