This tactic is as juvenile as it gets. If dismissal is legitimate, which it clearly is, a motion to dismiss (MTD) stands on its own merits and doesn't become triggered only by Dem's misbehavior. A MTD should be used to terminate a case and not be used as blackmail. In other words, the proposed approach implicitly admits the merits of the motion but McConnell and the other Republicans agree not to use it if the Dems behave themselves.
