A federal appeals court has ruled the Trump administration can divert $3.6 billion in military funds to build a wall along the U.S.-Mexico border.
Multiple reports indicate the 5th Circuit Court of Appeals voted 2-1 to temporarily stay a lower court ruling out of Texas.
Reuters reports the stay is pending an appeal by the Trump administration of the ruling by a federal judge that prevented the transfer of funds.
El Paso County, Texas, and the Border Network for Human Rights have been challenging the funds transfer.
The panel noted that the U.S. Supreme Court had issued a stay in a similar case from the 9th Circuit Court of Appeals.
Construction of a wall along the U.S.-Mexico border was the signature promise of President Donald Trumps 2016 campaign. Following last years government shutdown, Trump declared immigration a national emergency and used that as justification for siphoning funds to the wall. Critics have said the move circumvented the power of the purse that belongs to Congress.

Maryland gives free healthcare to illegals. I’ve observed the illegals from all the surrounding states go there for free healthcare.

If I have an expensive healthcare need in the future, what's to stop me from going to Maryland, undocumented, and getting free healthcare? I'm from NJ and have a hispanic-ish last name. If its summertime, I can even look the part with a decent tan (I live in a shore community).

They ruled on the $2.5 billion out of Military Counter-Narcotics funds that the President designated for Wall building.
This is for the $3.6 billion from Military Construction (MILCON) funds. Different pot of money, authorized by a separate law. The MILCON money is only authorized if the President declares an emergency under the National Emergencies Act. Counter-Narcotics funds are explicitly authorized for building border fences, roads and lighting in the legislation that established that program in the first place.
Both cases raise the same issue though - any one of the more than 600 Federal District Judges might try to “Veto” the President of the United States - even during a declared emergency.
Both of these cases will now still proceed at their own pace, but the President will not be restrained from acting until any and every Federal Judge feels good and ready to issue a final ruling.
On the legal merits, both types of funds are on a rock solid basis.
