Attorneys argue Trump has right to collect citizenship info

Attorneys for the Trump administration say the president has the right to order the U.S. Census Bureau to collect administrative records on citizenship.

The U.S. Department of Commerce asked a federal court in Maryland on Wednesday to dismiss a lawsuit challenging Trump’s order.

T he motion filed by administration attorneys was the latest development among several lawsuits around the nation, deriving from the administration’s failed attempt to put a citizenship question on the 2020 Census questionnaire. After the U.S. Supreme Court blocked the question from being added last summer, Trump issued the order requiring the U.S. Census Bureau to obtain citizenship information from administrative records instead.

Civil rights groups challenged Trump’s order, worried that citizenship information will be used by states and local governments to redraw legislative boundaries using only U.S. citizens instead of the entire population. They argued doing so would be advantageous to Republicans and non-Hispanic whites.

The language of Amendment XIV contains counting language and apportionment language.

It is the duty of Trump, the Census Bureau, the courts, etc. to respect Amendment XIV as written, which is possible but tedious work.

Senor Resident Ilicito must be counted, but he doesn’t factor into apportionment.

We will have maybe 370 million residents and about 340 million citizens. Apportionment will be based on those 340 million citizens(excluding DC residents).

Federal funding will generally be based on the 370 million residents, as Congress (and the President) get to decide.

We are not able to verify US citizenship in your case. A copy of your census form is attached. Please ensure any error with respect to US citizenship in your case gets corrected.

Correct - I prefer to describe it like this.

The census counts people, the 14th requires identification of a sub-set of that count which is citizens.

I am of the opinion that when SCOTUS ruled to not include the question, they ruled incorrectly.

The problem is ah*le Democrats that don't respect the Constitution and Amendments as written. They want additional questions on the Census that favor illegal criminals and do not allow valid questions that favor citizens. Despite President Trump trying to do his duty, the ah*le Democrats circumvent our nation's rules and laws!

IOW, they are not civil rights groups.

Not sure if the Constitution wanted districts determined by citizens, but I think it did.
If so, then this info is needed.

Mu impression is that the Department considered impact on the Party of considering citizenship. I do not think such a consideration rules out the collection of the info.
Party preference is not inherently a racial qualification.

You’re welcome. outline.com or the browser add-on Reader View, available at https://add0n.com/chrome-reader-view.html will usually allow you to get past paywalls. Exception is the WSJ. Their paywall is impenetrable AFAIK.

What I do if I really want to read a WSJ article is search title and/or text until I come across some small third-party site or blog that has reposted it in full.

Most of the time that works.

Not doing so is disadvantageous to USA citizens. It undermines and dilutes our votes in the what is supposed to be our representative government-spit.
